Abstract

Adanya ketidakseimbangan dalam Perjanjian Pengikatan Jual Beli (PPJB) mengakibatkan kerugian bagi konsumen yang membatalkan pembelian unit apartemen, walaupun pembatalan tersebut dikarenakan adanya kesalahan dari pihak pengembang. Hal tersebut dikarenakan tidak adanya pengaturan secara eksplisit terkait dengan Perjanjian Pengikatan Jual Beli (PPJB), akibat adanya asas kebebasan berkontrak sebagaimana diatur dalam Pasal 1320 KUHPerdata. Penelitian ini menggunakan metode yuridis normatif dengan pengumpulan data yang digunakan adalah data sekunder dan didukung data primer. Hasil dari penelitian ini bahwa pengaturan prinsip keadilan dan kepastian hukum dalam Perjanjian Pengikatan Jual Beli (PPJB) apartemen di Indonesia masih memiliki kelemahan, yaitu PPJB tersebut dapat dibuat di bawah tangan, sehingga kekuatan hukumnya tidak sempurna seperti PPJB yang dibuat oleh Notaris sebagaimana diatur dalam Pasal 42 ayat (1) Undang-Undang Nomor 1 Tahun 2011 tentang Perumahan dan Kawasan Permukiman yang mengatur bahwa rumah tunggal, rumah deret, dan/atau rumah susun yang masih dalam tahap proses pembangunan dapat dipasarkan melalui sistem perjanjian pendahuluan jual beli sesuai dengan ketentuan peraturan perundang-undangan. Adanya frasa “dapat” dalam ketentuan tersebut menyebabkan tidak adanya kewajiban bagi pengembang dan konsumen untuk membuat PPJB dihadapan Notaris, yang menyebabkan ketidakseimbangan kedudukan antara pengembang dengan konsumen. / An imbalance position in the Sales and Purchase Agreement resulted in losses for consumers who canceled the purchase of apartment units, even though the cancellation was causel by fault in the developer side. That is because there is no explicit regulation related to the Sale and Purchase Agreement, due to the principle of freedom of contract as regulated in Article 1320 of the Civil Code. This study uses normative juridical methods with data collection used is secondary data and supported by primary data. The results of this study show that the regulation of the principle of justice and legal certainty in the Agreement on Binding of Buy and Sell apartments in Indonesia remains weak, he partucular, the PPJB can be made under hand goverments, so that the legality of the agreement is not perfect as PPJB made by a Notary Public defined by Article 42 paragraph (1) of Law Number 1 of 2011 concerning Housing and Settlement Areas this law stipulates that single houses, series houses and / or flats that are still in the construction process allowable to be marketed through a system of preliminary sale and purchase agreement in accordance with statutory provisions -invitation. The existence of the phrase "can" in this provision indicate that no obligation for developers and consumers to make the Agreement on Binding of Buy and Sell before a notary, which causes an imbalance between the developer and the consumer.
