Abstract

Seiring dengan perkembangan ilmu pengetahuan dan teknologi, muncul inovasi baru di bidang transportasi yaitu adanya taksi online. Kehadiran taksi online memudahkan masyarakat karena dianggap lebih mudah diakses, lebih praktis dan tarifnya yang terjangkau. Terdapat dua perusahaan taksi online di Indonesia, yaitu Go Jek dan Grab. Jasa yang ditawarkan oleh Go Jek dan Grab konsepnya hampir sama seperti taksi konvensional. Namun, perbedaan terletak pada penetapan tarifnya, Go Jek dan Grab menganut sistem high fare due to high demand atau tarif melonjak akibat tingginya permintaan pengguna jasa pada saat jam tertentu (rush hour). Lain halnya dengan taksi konvensional yang menggunakan argometer dalam menetapkan tarifnya. Dalam thesis ini, penulis akan menganalisis apakah penetapan tarif yang dilakukan oleh Go Jek dan Grab telah menaati Peraturan Menteri Perhubungan Nomor 118 Tahun 2018 tentang Penyelenggaraan Angkutan Sewa Khusus dan tarif manakah yang lebih melindungi konsumen jika dikaitkan dengan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Penulis menggunakan metode penelitian yuridis normatif dengan menggunakan sumber hukum primer dan sekunder. Dari hasil penelitian ini diketahui bahwa penetapan tarif yang diterapkan oleh Go Jek dan Grab tidak sesuai dengan Pasal 1 Angka 15 Pemenhub 118 Tahun 2018 yang mewajibkan seluruh perusahaan angkutan sewa khusus menaati peraturan tarif batas atas dan tarif batas bawah dan Pasal 27 Permenhub 118 Tahun 2018 poin (a) yang menjelaskan bahwa perusahaan dilarang menetapkan tarif. Tarif yang lebih melindungi konsumen jika ditinjau berdasarkan UUPK adalah tarif taksi konvensional karena penetapan tarif yang diterapkan oleh Go Jek dan Grab merugikan beberapa hak konsumen, diantaranya Pasal 4 poin (a) UUPK yaitu hak atas kenyamanan, keamanan, dan keselamatan, Pasal 4 poin (b) UUPK yaitu hak untuk memilih barang dan/atau jasa serta mendapatkan barang dan/atau jasa tersebut sesuai dengan nilai tukar dan kondisi serta jaminan yang dijanjikan dan Pasal 4 poin (c) UUPK yaitu hak atas informasi yang benar, jelas, dan jujur mengenai kondisi dan jaminan barang dan/atau jasa./Along with the development of science and technology, innovation in the field of transportation emerged, proven by the existence of online taxi. The presence of online taxi make thing easier in people's life, online taxi considered more accessible, practical and also they have affordable rates. There are two online taxi companies in Indonesia, called Go Jek and Grab. The service which is offered by Go Jek and Grab is having the same concept with conventional taxi. However, the difference lies in the determination of tariff. Go Jek and Grab adopt a high fare due to high demand system, tariff will be jumped due to services is on high demand at certain hours, called rush hour. Another case with conventional taxi which use taximeter on their tariff settings. Therefore, the author will analyze whether tariff determination which applied by Go Jek and Grab has complied with Regulation of Ministry of Transportation of the Republic Indonesia Number 118 Year 2018 regarding Online Transportation and which tariff is more protective to consumer according to Law of the Republic Indonesia Number 8 Year 1999 regarding Consumer Protection. The author uses normative juridical research methods using primary and secondary legal sources. From the results of this study, tariff determination which applied by Go Jek and Grab is not in accordance with Article 1 Number 15 of the Regulation of Ministry of Transportation of the Republic Indonesia Number 118 Year 2018 which requires all online taxi company to comply with the upper and lower limit tariff regulations and Article 27 points (a) of the Regulation of Ministry of Transportation of the Republic Indonesia Number 118 Year 2018 which explains that online taxi company is prohibited from setting tariffs. Furthermore, tariff which is more protective for consumer according to UUPK is tariff applied by conventional taxi. Because the tariff determination which applied by Go Jek and Grab harms several consumer rights, such as Article 4 point (a) UUPK, namely the right to comfort, security and safety, Article 4 point (b) UUPK namely the right to choose goods and/or services and to get goods and/or services in accordance with the exchange rate and conditions and guarantees promised and Article 4 point (c) of UUPK, namely the right to true, clear and honest information about conditions and guarantees of goods and/or services.
