Abstract

Indonesian regulations regarding rape are still very conservative and require significant changes starting from the definition. In Article 285 of the Criminal Code in Indonesia only protects legal subjects that are considered weak by members of parliament namely female while male as other legal subjects cannot be victims of rape. The reason for choosing this topic is to find out the form of legal protection from the Indonesian government for adult male as legal subjects if they are victims of rape by female using normative legal research methods, through the statute approach, case approach and comparative approach by presenting various real rape cases in various countries to compare various laws and regulations of various countries to get solutions to problems arising from article 285 of the Criminal Code with a form of prevention will be a problem that can arise in the future as a form of preventive legal protection which is the main objective of this dissertation. The conclusion of the discussion of this research is the need for redefinition of Article 285 of the Criminal Code concerning rape. The conclusion of this research is the need for redefinition of article 285 of the criminal code concerning rape. One of the goals of the need for redefinition in this study is the regulation able to provide legal certainty and legal protection for anyone, both perpetrators and victims without discrimination in the context of Equality before the Law. Especially for adult male victims because the positive law in Indonesia does not stipulate that adult male can be victims of rape given that Indonesia adheres to the Principle of legality so the need to redefine this regulation needs to immediately enacted for the creation of justice. / Peraturan Indonesia terkait pemerkosaan masih sangat konservatif dan membutuhkan perubahan signifikan mulai dari definisi. Dalam Pasal 285 KUHP di Indonesia hanya melindungi subyek hukum yang dianggap lemah oleh anggota parlemen yaitu perempuan sedangkan laki-laki sebagai subyek hukum lainnya tidak boleh menjadi korban perkosaan. Alasan dipilihnya topik ini adalah untuk mengetahui bentuk perlindungan hukum dari pemerintah Indonesia bagi laki-laki dewasa sebagai subyek hukum jika menjadi korban perkosaan oleh perempuan dengan menggunakan metode penelitian hukum normatif, melalui pendekatan statuta, pendekatan kasus dan pendekatan komparatif oleh menyajikan berbagai kasus perkosaan yang nyata di berbagai negara dengan membandingkan berbagai peraturan perundang-undangan dari berbagai negara untuk mendapatkan solusi atas permasalahan yang timbul dari pasal 285 KUHP dengan bentuk pencegahan akan menjadi masalah yang dapat muncul dikemudian hari sebagai bentuk pencegahan. perlindungan hukum yang menjadi tujuan utama disertasi ini. Kesimpulan dari pembahasan penelitian ini adalah perlunya redefinisi Pasal 285 KUHP tentang pemerkosaan. Kesimpulan dari penelitian ini adalah perlunya redefinisi pasal 285 KUHP tentang pemerkosaan. Salah satu tujuan perlunya redefinisi dalam penelitian ini adalah regulasi yang mampu memberikan kepastian hukum dan perlindungan hukum bagi siapa saja, baik pelaku maupun korban tanpa diskriminasi dalam konteks Equality before the Law. Khusus untuk korban laki-laki dewasa karena hukum positif di Indonesia tidak mengatur bahwa laki-laki dewasa dapat menjadi korban perkosaan mengingat Indonesia menganut asas legalitas sehingga perlu adanya redefinisi peraturan ini perlu segera diberlakukan demi terciptanya keadilan.
