Abstract

The purpose of this study is to demonstrate and explain the State Policy Law Politics Closed ever launched in Jakarta in 1970 by the Jakarta administration. In that year, Jakarta experiencing soaring high in-migration, so that the policy is expected to reduce the rate of migration. This study then examines the juridical implications of establishing these policies, whether these policies can reduce the rate of migration as expected. The study also conducting studies of population policy solutions especially Jakarta population mobility in the present, by comparing the products covered city policy law in Jakarta in 1970 with the demographic situation and the legal system applicable in the present. This research is using a normative deductive analysis. The study was conducted by reviewing the main research subject in the form of legislation which is applicable both in 1970 and in recent times associated with Population Control Policy in particular mobility of people in Jakarta. Researchers also gather data from law books theory and interview key informant from Head of Jakarta Population and Civil Registry. The results of the research is law politics Closed State Policy in Jakarta in 1970 was due to migration into Jakarta is soaring to interfere with the course of development, but the policy is not to suppress the rate of in-migration. Policy referred to in the end is not in accordance with the current legal system for their protection of Indonesian citizens to move and reside for in the Homeland. However, the national legal system allows countries to restrict human rights for the sake of wider human rights and the actual state has had regulations in accordance with the policy elements Jakarta Kota Closed for example, rules regarding the administrative requirements for immigrants such as Law No. 24 of 2013 jo. 23 of 2006 on "Population Administration", Perda No. 2 of 2011 on "Population and Civil Registration" as well as the Regulation of the Minister of Interior of the Republic of Indonesia No. 14 2015 on "Data Collection Guidelines for Non-Permanent Residents". With the increasingly rapid development of Jakarta and distribution of the population has spread to neighboring areas, the researchers see the urgency of national policies that are integrated so not only apply to Jakarta but for Bogor, Depok, Tangerang, and Bekasi. / Tujuan dari penelitian ini adalah untuk membuktikan dan menjelaskan Politik Hukum Kebijakan Kota Tertutup yang pernah dicanangkan di Jakarta tahun 1970 oleh pemerintah DKI Jakarta. Di tahun tersebut Jakarta mengalami lonjakan migrasi masuk yang tinggi, sehingga kebijakan tersebut diharapkan dapat menekan laju migrasi. Penelitian ini lalu mengkaji implikasi yuridis dari penetapan kebijakan tersebut, apakah kebijakan tersebut dapat menekan laju migrasi seperti yang diharapkan. Penelitian ini juga melakukan pengkajian solusi kebijakan kependudukan khususnya mobilitas penduduk Jakarta di masa sekarang, dengan membandingkan antara produk hukum kebijakan kota tertutup di Jakarta tahun 1970 dengan kondisi kependudukan dan sistem hukum yang berlaku di masa sekarang. Penelitian ini merupakan penelitian normatif dengan analisa deduktif. Penelitian dilakukan dengan mengkaji subjek penelitian utama berupa peraturan perundangundangan yang berlaku baik di tahun 1970 serta di masa sekarang terkait dengan Kebijakan Pengendalian Kependudukan khususnya mobilitas penduduk di Jakarta. Peneliti juga menggunakan buku-buku teori hukum serta mewawancarai narasumber Kepala Dinas Kependudukan dan Catatan Sipil Jakarta. Hasil penelitian yang didapat yaitu politik hukum Kebijakan Kota Tertutup di Jakarta tahun 1970 adalah karena migrasi masuk Jakarta yang melonjak tinggi hingga mengganggu jalannya pembangunan, akan tetapi kebijakan tersebut tidak berhasil menekan laju migrasi masuk. Kebijakan dimaksud pada akhirnya sudah tidak sesuai dengan sistem hukum yang berlaku sekarang karena adanya perlindungan hak warga Indonesia untuk berpindah dan bertempat tinggal selama di wilayah NKRI. Walaupun begitu, sistem hukum nasional memperbolehkan negara melakukan pembatasan HAM demi kepentingan HAM yang lebih luas dan sebenarnya Negara telah memiliki peraturan-peraturan yang sesuai unsurunsurnya dengan Kebijakan Jakarta Kota Tertutup misalnya peraturan terkait persyaratan administrasi bagi pendatang seperti UU No. 24 tahun 2013 jo. 23 tahun 2006 tentang “Administrasi Kependudukan”, Perda No. 2 tahun 2011 tentang “Pendaftaran Penduduk dan Catatan Sipil” serta Peraturan Menteri Dalam Negeri Republik Indonesia No. 14 tahun 2015 tentang “Pedoman Pendataan Penduduk Non Permanen”. Dengan pembangunan Jakarta yang semakin pesat dan persebaran penduduk telah meluas ke daerah-daerah sekitarnya, peneliti melihat urgensi kebijakan nasional yang bersifat terintegrasi jadi tidak hanya berlaku bagi Jakarta tetapi bagi Bogor, Depok, Tangerang, dan Bekasi.
