Abstract
Deliberation to achieve consensus as a legal culture to solve problems has been
rooted in Indonesian culture. However in reality the legal culture is remain often
tobe overlooked in the settlement of business contract through arbitration. This
study aims to addres 3 (three) legal problems, firstly, how the legal culture of
consensus to acclaim as a joint or value in the philosophy of Pancasila affects the
formulation of the norms of arbitration law; second, how the implementation of
legal culture of consensus for acclamations as one of the joints or values in the
foundation of Pancasila state philosophy in the dispute of business contract; and
thirdly, how to revitalize the legal culture of deliberation for consensus in the
policy of arranging the dispute settlement of business contract through
arbitration.
This research is normative legal research, that is using secondary data.
conclusion of the analysis can be summerized as follows, first, the legal culture of
consensus to consensus as the value of Pancasila not fully underlying and affect
the formulation of the norms of arbitration law in Law no. 30 of 1999. The legal
culture of musyawarah for consensus should be used as a parameter to perfect the
formulation of the substance of legal norms and procedural aspects. Second, a
large number of indigenous peoples and social communities that still apply and
preserve the noble values, traditions and local wisdom can be a force affecting the
attitude of the community to be reluctant to dispute let alone through formal
institutions in court. Third, future arbitration requires a revision of substantive
norms and procedural provisions that can reinforce the legal culture of
deliberation for consensus. Revisions must be based solely on the soul and culture
of the law, local wisdom excavated from law and practice by customary
institutions, such as the principle of harmony, deliberation for consensus is the
truth of truth, mutual cooperation, mutual respect, upholding, value -balance of
balance and harmonization, and carry out what has been agreed upon. / Musyawarah untuk mencapai mufakat sebagai budaya hukum untuk
menyelesaikan permasalahan sosial telah berakar dalam budaya Indonesia.
Namun kenyataannya budaya hukum seperti itu masih sering diabaikan dalam
proses penyelesaian sengketa kontrak bisnis melalui arbitrase. Dengan latar
belakang itu, penelitian ini disusun dengan tujuan untuk menjawab tiga
permasalahan berdimensi hukum, yakni pertama, bagaimana budaya hukum
musyawarah untuk mufakat sebagai sendi atau nilai dalam falsafah Pancasila
mempengaruhi perumusan norma hukum arbitrase; kedua, bagaimana
implementasi budaya hukum musyawarah untuk mufakat sebagai salah satu sendi
atau nilai dalam landasan falsafah negara Pancasila dalam proses penyelesaian
sengketa kontrak bisnis; dan ketiga, bagaimana merevitalisasi budaya hukum
musyawarah untuk mufakat dalam kebijakan pengaturan penyelesaian sengketa
kontrak bisnis melalui arbitrase.
Dari segi metodologi, penelitian ini adalah penelitian hukum normatif,
dengan menggunakan data sekunder. Berdasarkan analisis dapat disimpulkan,
pertama, budaya hukum musyawarah untuk mufakat sebagai nilai Pancasila
belum sepenuhnya melandasi dan mempengaruhi perumusan norma hukum
arbitrase dalam UU No. 30 Tahun 1999. Budaya hukum musyawarah untuk
mufakat seharusnya digunakan sebagai parameter untuk menyempurnakan
perumusan substansi norma-norma hukum dan tatanan prosedural. Kedua,
sejumlah besar masyarakat adat dan komunitas sosial yang masih menerapkan dan
melestarikan nilai-nilai luhur, tradisi maupun kearifan lokal dapat menjadi
kekuatan mempengaruhi sikap masyarakat untuk menghindari sengketa apalagi
melalui lembaga formal di pengadilan. Ketiga, arbitrase di masa depan
membutuhkan revisi norma-norma substantif dan prosedural yang dapat
mengukuhkan budaya hukum musyawarah untuk mufakat. Revisi harus benarbenar berlandaskan pada jiwa dan budaya hukum, dan kearifan lokal yang digali
dari hukum dan praktik oleh lembaga-lembaga adat, seperti prinsip kerukunan,
musyawarah untuk mufakat yang merupakan kebenaran yang sebenar-benarnya,
gotong royong, saling menghormati, menjunjung tinggi nilai-nilai keseimbangan
dan harmonisasi, dan melaksanakan apa yang telah disepakati.
