Abstract

The problem of abandoned land is still common in Indonesia. One of the land abandonment cases that occurred between PT Pasetran Wanarattindo and BPN RI. Right to build certified land designated as wastelands by BPN RI. PT Pasetran Wanarattindo Attack filed to the administrative court. With the argument has been put forth, exploit and utilize both physically and economically. Has proven mining rights and the land once used as loan collateral. At the level of the Administrative Court and the Supreme Court was won by PT Pasetran Wanarattindo. The problem in this paper is how a piece of land designated as wastelands and whether land mining rights can be categorized as wasteland. This type of method used in this research is the method of normative legal research is a method that uses the literature accompanied by interviews. The results of the research is the process of defining wastelands done with 4 (four) stages. And physical activity do not use the land in accordance with the nature and purpose of their rights. Originally granting the right to establish a warehouse but until near the end of the validity period there is any building on it. The conclusion is that the process of establishing wastelands done through several stages, but in the third stage which an alert is sent to the wrong address so that PT Pasetran Wanarattindo not aware of any such warning due to PT Pasetran Wanarattindo has changed domicile and PT Pasetran Wanarattindo not tell domicile / new address to the BPN City Cilegon and Kakanwil Banten. PT Pasetran Wanarattino who do not use the land in the manner intended action is wrong and contrary to the legislation and categorized as wasteland. / Permasalahan tanah telantar masih sering terjadi di Indonesia. Salah satu kasus penelantaran tanah yang terjadi antara PT Pasetran Wanarattindo dan BPN RI. Tanah yang bersertifikat HGB ditetapkan sebagai tanah telantar oleh BPN RI. PT Pasetran Wanarattindo mengajukan gugatan ke PTUN Serang. Dengan dalil sudah mengusahakan, memanfaatkan dan mempergunakan baik dari segi fisik maupun ekonomis. Terbukti telah mendapatkan ijin pertambangan dan tanah tersebut pernah dijadikan jaminan kredit. Pada tingkat PTUN dan MA dimenangkan oleh PT Pasetran Wanarattindo. Permasalahan dalam penulisan ini ialah bagaimana sebidang tanah ditetapkan sebagai tanah telantar dan apakah tanah yang mendapatkan ijin pertambangan dapat dikategorikan sebagai tanah telantar. Jenis metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif yaitu metode yang menggunakan bahan kepustakaan disertai juga dengan wawancara. Hasil penelitian ialah proses penetapan tanah telantar dilakukan dengan 4 (empat) tahapan. Serta kegiatan fisik penggunaan tanah tersebut tidak sesuai dengan sifat dan tujuan pemberian haknya. Semula pemberian haknya untuk mendirikan gudang namun hingga masa berlakunya hampir habis tidak terdapat bangunan apapun di atasnya. Kesimpulannya ialah proses penetapan tanah telantar dilakukan melalui beberapa tahapan namun pada tahap ketiga yaitu peringatan dikirim ke alamat yang salah sehingga PT Pasetran Wanarattindo tidak mengetahui adanya peringatan tersebut dikarenakan PT Pasetran Wanarattindo telah berpindah domisili dan PT Pasetran Wanarattindo tidak memberitahu domisili/ alamat baru kepada BPN Kota Cilegon dan Kakanwil Banten.Tindakan PT Pasetran Wanarattino yang tidak menggunakan tanahnya sesuai dengan peruntukannya adalah tindakan yang keliru dan bertentangan dengan peraturan perundang-undangan dan dikategorikan sebagai tanah telantar.
