Abstract
Nowadays many house purchases are made by using the system of pre-selling
project (purchase before the house is completed). The signing of the Sale and
Purchase Agreement (Perjanjian Pengikatan Jual Beli/PPJB) is bound the parties
to fulfill their obligations to the house it is conducted before the house is
completed. In practice, PPJB is determined unilaterally by the developer (standard
contract), and only considers the interests of the developer. The PPJB is also not
made in front of the Notary, so that in the event of default it only has the strength
of evidence as the deed under hand which cannot be used as strong as evidence for
the claim purchaser.This study aims to examine the legal protection arrangements
for house buyers in the Decree of the State Minister of Housing No. 09 / KPTS /
M / 1995, the force of law in terms of the completion of the PPJB default by the
developer, and legal settlement if the developer has refused to comply with the
achievement due to reason that PPJB which is made in front of the Notary does
not have the force of law.This study is a normative juridical research, i.e. legal
research on normative legal provisions (codification, law, or contract). The data
used is secondary data, and techniques for data collection are literature and
documentation. Analysis of the data used is qualitative analysis research with
normative juridical approach.Based on the analysis and discussion that has been
done, it can be seen that the arrangement of the legal protection of house buyers in
the Decree of the State Minister of Housing No. 09 / KPTS / M / 1995 is done by
determining the obligations of the seller and buyer in a balanced way, guarantee
legal certainty the seller to the buyer, as well as provisions cancellation of the
agreement, and its legal consequences. It is also noted that the force of law in
terms of the completion of the PPJB defaults by developers is depending on the
making of the PPJB itself. If the PPJB is made in front of the Notary, then it has
the properties as authentic document which has the strength, so it can be served as
strong evidence when there is a dispute. If not, then the PPJB has the properties as
a deed under hand which can be denied by the parties and is not binding on third
parties. If the developer has refused to comply with the achievement of PPJB due
to reasons that it is not made in front of the Notary and does not have the force of
law, then the legal settlement is done by filing prosecution in court. The
prosecution could be done administratively based on Article 150 paragraph (2) of
Law No. 1 Th. 2011, or Article 61 of Law No. 8 Th. 1999. It could also be
criminally charged with use of Article 62 and 63 of Law No. 8 Th. 1999, or
Article 378 of the Criminal Code. / Penjualan rumah banyak dilakukan dengan menggunakan sistem pre project
selling (penjualan sebelum rumah jadi). Untuk mengikat para pihak agar
memenuhi kewajibannya masing-masing dilakukan Perjanjian Pengikatan Jual
Beli (PPJB). Dalam prakteknya PPJB ditentukan secara sepihak oleh pengembang
(perjanjian baku) dan hanya memperhatikan kepentingan pengembang. PPJB juga
tidak dibuat di depan Notaris, sehingga ketika terjadi wanprestasi PPJB hanya
mempunyai kekuatan pembuktian sebagai akta di bawah tangan.
Penelitian ini bertujuan untuk mengetahui pengaturan perlindungan hukum
terhadap pembeli rumah dalam Undang-undang Nomor 1 Tahun 2011 dan
Keputusan Menteri Negara Perumahan Rakyat Nomor 09/KPTS/M/1995,
kekuatan hukum PPJB dalam hal terjadi wanprestasi oleh pengembang, dan
penyelesaian hukumnya jika pengembang menolak memenuhi prestasi dengan
alasan PPJB tidak dibuat di depan Notaris tidak mempunyai kekuatan hukum.
Penelitian ini merupakan penelitian yuridis normatif, yaitu penelitian hukum
mengenai ketentuan hukum normatif (kodifikasi, Undang-Undang atau kontrak).
Data yang digunakan adalah data sekunder dengan teknik pengumpulan data studi
pustaka dan dokumentasi. Analisis data yang digunakan adalah analisis kualitatif
dengan pendekatan yuridis normatif.
Berdasarkan analisis dan pembahasan yang telah dilakukan, dapat diketahui
bahwa pengaturan perlindungan hukum terhadap pembeli rumah dalam UU No. 1
Th. 2011 adalah mewajibkan penjualan rumah yang belum jadi harus
dilaksanakan menggunakan PPJB. Sedangkan perlindungan hukum menurut
Keputusan Menteri Negara Perumahan Rakyat Nomor 09/KPTS/M/1995
dilakukan dengan menentukan kewajiban penjual dan pembeli secara seimbang,
jaminan penjual untuk kepastian hukum pembeli, serta ketentuan pembatalan
perjanjian dan akibat hukumnya. Selain itu diketahui bahwa kekuatan hukum
PPJB dalam hal penyelesaian wanprestasi oleh pengembang tergantung dari
pembuatan PPJB itu sendiri. Jika PPJB dibuat di depan Notaris, maka PPJB itu
mempunyai sifat sebagai akta otentik, yaitu mempunyai kekuatan pembuktian
yang sempurna, sehingga dapat dijadikan sebagai alat bukti yang kuat manakala
terjadi sengketa. Jika tidak, maka PPJB itu mempunyai sifat sebagai akta di bawah
tangan yaitu bisa diingkari oleh para pihak dan tidak mengikat pihak ketiga.
Penyelesaian hukumnya jika pengembang menolak memenuhi prestasi dengan alasan PPJB yang tidak dibuat di depan Notaris tidak mempunyai kekuatan
hukum adalah mengajukan penuntutan di muka pengadilan. Penuntutan ini bisa
secara administrasi dengan menggunakan dasar Pasal 150 ayat (2) UU No. 1 Th.
2011 atau Pasal 61 UU No. 8 Th. 1999, bisa juga dituntut secara pidana dengan
menggunakan Pasal 62 dan 63 UU No. 8 Th. 1999 atau Pasal 378 KUHP.
