Abstract
Land Registration is obligation of state which executed by the Head of the
National Land Office with the assistance of officials such as PPAT, in accordance
with Government Regulation No. 24 of 1997 about Land Registration. For that
needs to be known about the roles and responsibilities of PPAT in the
implementation of land registration activities, as many who do not understand the
PPAT and ignore the role and functions of the office. Law No. 5 of 1960 that
proof of the right to a plot of land in Indonesia is a certificate of proof of land
rights. In society, the fact that buying and selling land without a certificate only by
proof of payment of tax on land is still going on, which is proof of payment of
taxes on the land only as a tax on land. While the certificate is strong evidence
regarding land rights. Therefore, this situation can give rise to a dispute over the
ownership of the same land area as in the case number 147 / Pdt.G / PN.Jaktim /
2009 which was won by plaintiffs who have made before PPAT certificate
because it has met the elements in the process of buying procedure of land rights.
The method used is to use a normative legal research is to examine the sheer
library materials. Data collection method used is literature study supported by
field studies in the form of interviews and the data obtained were analyzed
qualitatively in the implementation of land registration activities, roles and
responsibilities of PPAT very large, this is related to the function of a deed made
by PPAT that as evidence that he had done a certain legal actions and as a basis
for land regiskation is done at the land office. So that in the absence of a deed
made.by PPAT, it will be very difficult to perform maintenance activities of land
registration data, as in the implementation of land registration, PPAT deed is
mandatory binding. / Pendaftaran tanah merupakan kewajiban negara yang dilaksanakan oleh Kepala
Kantor Pertanahan Nasional dengan dibantu Pejabat-pejabat seperti PPAT, sesuai
dengan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah.
Untuk itu perlu diketahui mengenai peran dan tanggung jawab ppAT dalam
rangka pelaksanaan kegiatan pendaftaran tanah, karena banyak PPAT yang tidak
memahami serta mengabaikan peran dan fungsi jabatannya. Undang-Undang
Nomor 5 Tahun 1960 bahwa bukti hak atas sebidang tanah di Indonesia adalah
sertifikat tanda bukti hak atas taflah. Di masyarakat, faktanya bahwa jual beli
tanah tanpa sertifikat yang hanya berdasarkan bukti pernbayaran pajak atas tanah
masih terjadi, yang mana bukti pembayaranpajak atas tanah hanya sebagai pajak
atas tanah. Sedangkan sertifikat adalah bukti yang kuat mengenai hak atas tanah.
Oleh karena itu, keadaan ini dapat menimbulkan suatu sengketa kepemilikan hak
di atas satu area tanah yang sama seperti dalam kasus nomor
147/Pdt.GlPN.Jaktiml2009 yang dimenangkan oleh penggugat yang memiliki
sertifikat yang dibuat dihadapan PPAT karena telah mernenuhi unsur dalam
proses prosedurjual beli hak atas tanah.
Metode penelitian yang digunakan adalah dengan menggunakan penelitian hukum
normatif yaitu dengan meneliti bahan pustaka belaka. Metode pengumpulan data
yang dipakai adalah studi kepustakaan yang ditunjang dengan studi lapangan
berupa hasil wawancara dan data yang diperoleh dianalisa secara kualitatif dalam
pelaksanaan kegiatan pendaftman tanah, Peran dan tanggung jawab PPAT sangat
besar, hal ini berkaitan dengan fungsi akta yang dibuat oleh PPAT yaitu sebagai
bukti bahwa telah dilakukannya suatu perbuatan hukum tertentu dan sebagai dasar
pendiftaran tanah yang dilakukan di kantor pertanahan. Sehingga tanpa adanya
suatu akta yang dibuat oleh PPAT, maka akan sangat sulit untuk melakukan
kegiatan pemeliharaan data pendaftaran tanah, karena dalam pelaksanaan kegiatan
pendaftaran tanah, akta PPAT merupakan keharusan yang mengikat.
