Abstract
Given land vacant land that will be used as the grave is limited, while the
demand for land has run out and the manager must keep providing new land, then
as a manager was forced to evict the tomb that had not been taken care of by his
heirs, by way of overlapping bodies in a rut lahat. This condition is deliberately
done by the manager of the cemetery to overcome the limitations of the land
happens. With the phenomenon of the above, the management of the grave to be
important in order to meet the needs of modern society. Along with the need for
such services, many of the public as well as private sector entities / companies law
looked the cemetery can be a business that can provide benefits. Although in the
Government Regulation No. 9 of 1987 clearly establishes the burial place not
generally be managed by a legal entity that upholds religious and social values.
But the reality today as regardless of the existing regulations, there are some
common burial place is not administered by a Limited Liability Company.
This research is descriptive analysis, the research aimed to obtain a
thorough, complete and systematic on the Use and Utilization of Land as Land
Tomb conducted by the Agency Limited Liability Company Law, where this
research will be assessed in accordance with Regulation Legislation and
Regulations launnya relating to the Land Use and Utilization.
Results Stating that the Agency limited liability company could obtain
land rights afforded the grave, but the status of the rights granted by the
government is the right of use that has a time limit and may be extended in
accordance with the applicable rules. Hak Pakai is granted for a period of 25 years
and can diperanjang back with a 25-year period. However, if the right to use it has
expired and the developer does not extend, the rights of the land will go back into
state property. state. / Mengingat lahan tanah kosong yang akan dipergunakan sebagai tanah
makam terbatas, sedangkan permintaan lahan sudah habis dan pengelola harus
tetap memberikan lahan baru, maka sebagai pengelola terpaksa harus menggusur
makam yang telah lama tidak diurus oleh ahli warisnya, dengan cara melakukan
tumpang tindih jenazah dalam satu liang lahat. Kondisi ini sengaja dilakukan oleh
pengelola pemakaman untuk mengatasi keterbatasan lahan yang terjadi. Dengan
adanya fenomena tersebut di atas, maka pengelolaan tanah makam menjadi
penting guna memenuhi kebutuhan masyarakat modern. Seiring dengan
kebutuhan akan pelayanan tersebut, maka banyak dari pihak swasta baik
masyarakat maupun badan usaha/ badan hukum memandang tempat pemakaman
dapat dijadikan sebuah bisnis yang bisa memberikan keuntungan. Walaupun
didalam Peraturan Pemerintah No 9 Tahun 1987 dengan jelas menetapkan tempat
pemakaman bukan umum dapat dikelola oleh badan hukum yang menjunjung
nilai social dan keagamaan. Namun realita yang ada saat ini seperti tanpa
memperdulikan peraturan yang telah ada, terdapat beberapa tempat pemakaman
bukan umum dikelola oleh badan hukum Perseroan Terbatas.
Penelitian ini bersifat deskriptif analisis, yaitu penelitian yang bertujuan
untuk memperoleh gambaran yang menyeluruh, lengkap dan sistematis mengenai
Penggunaan dan Pemanfaatan Tanah sebagai Tanah Makam yang dilakukan oleh
Badan Hukum Perseroan Terbatas, dimana penelitian ini akan dikaji sesuai
dengan Peraturan Perundang-Undangan dan Peraturan-Peraturan launnya yang
berkaitan dengan Penggunaan dan Pemanfaatan Tanah.
Hasil Penelitian Menyatakan bahwa Badan hukum perseroan terbatas bisa
memperoleh hak atas tanah yang diusahakan tanah makam, namun status hak
yang diberikan oleh pemerintah adalah hak pakai yang memiliki batas waktu dan
dapat diperpanjang sesuai dengan aturan yang berlaku. Hak Pakai yang diberikan
untuk jangka waktu 25 tahun dan dapat diperanjang kembali dengan jangka waktu
25 tahun. Namun apabila Hak Pakai tersebut telah habis masa berlakunya dan
pengembang tidak memperpanjang, maka hak atas tanah tersebut akan kembali
menjadi milik negara. milik negara.
