Abstract
Undang-undang Nomor 13 Tahun 2013 is fundamental in the labor
world which should be obeyed and executed by employers and
employees. Recalling that an occupation is a matter which really affects
everyone’s daily life, the embodiment of the support from the
government through law protection is really needed. By using
qualitative normative research method, this research was conducted in
order to deeply see the protection of the labor law towards workforce in
Indonesia whose rights are often neglected by businessmen/employers
because labors are lack of comprehension about the related legislation
regarding the labor protection. From the result towards some cases on
Putusan-putusan Mahkamah Agung Republik Indonesia (Verdicts of the
Supreme Court of the Republic of Indonesia) in this writing shows that
the law protection effort seemingly has to be enhanced and needs to get
extra attentions from the government and from the country in order to
minimize all forms of conflicts/problems in the labor world between
employers and employees, and also in order to achieve social,
economic, and human rights prosperity in the labor world in Indonesia. / Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan
merupakan dasar dalam dunia ketenagakerjaan yang seyogyanya harus
dipatuhi dan dijalankan oleh pengusaha dan pekerja. Mengingat pekerjaan
adalah hal yang sangat berpengaruh besar dalam kehidupan setiap
manusia, maka wujud dukungan pemerintah melalui perlindungan hukum
sangatlah dibutuhkan. Penelitian ini dilakukan untuk melihat secara
mendalam perlindungan hukum terhadap tenaga kerja di Indonesia yang
seringkali diabaikan hak-haknya oleh pengusaha/pemberi kerja karena
kurang pemahaman pekerja/buruh akan peraturan perundang-undangan
yang terkait dengan perlindungan ketenagakerjaan dengan menggunakan
metode penelitian normatif kualitatif. Dari hasil penelitian terhadap
beberapa kasus pada Putusan-Putusan Mahkamah Agung Republik
Indonesia dalam penulisan ini menunjukkan bahwa upaya perlindungan
hukum bagi tenaga kerja di Indonesia dirasa masih harus ditingkatkan dan
perlu mendapatkan perhatian ekstra dari Pemerintah dan Negara, agar
dapat meminimalkan segala macam bentuk perselisihan/permasalahan
dalam dunia ketenagakerjaan antara pengusaha dengan pekerja, juga agar
dapat tercapainya kesejahteraan sosial, ekonomi dan hak asasi manusia
dalam dunia ketenagakerjaan di Indonesia.
