Abstract
Land is an important matter in the life of the Indonesian people. One of the ways to
acquire land is through the Sale and Purchase of Land Title as it has now been governed
in the Government Regulation Number 24 of 1997 on Land Registration and Government
Regulation Number 37 of 1998 on Regulation of Land Deed Official (PPAT). Under these
legislations, such sale and purchase deed must be drawn up before the authorized official,
in the case of Land the Land Deed Official (PPAT) whose working area covers the area
where the land is located. The complexity of compliance with all requirements relating to
the implementation of sale and purchase before the Notary Public, a legal breakthrough
has been found and to this point in time it is still the general practice in sale and purchase
of land. The solution is drawing up a deed of sale and purchase agreement (PJB), in
which the parties acknowledge the actuality of sale and purchase of land although the
format is limited to “sale and purchase agreement”, namely a form of agreement that
constitutes or can be said to be only a preliminary agreement. This research is aimed at
identifying the Status of Practice of Sale and Purchase Agreement over Land Title under
Incomplete Requirement. This research is a descriptive analysis with the judicial,
empirical approach, while the date were obtained through bibliography research and field
research. From the results of this research, it is concluded that legal power of the deed of
sale and purchase over land title drawn up before a Notary Public is, in the
implementation of the Deed of Sale and Purchase Agreement, very strong, because the
deed is a notarial deed, which in character is an authentic deed, and the granting of
irrevocable power in the sale and purchase agreement is not categorized in the absolute
power prohibited by the Instruction of the Minister of Home Affairs Number 14 0f 1982
on Prohibition against the Use of Absolute Power in Transfer of Land Title, so that the legal status is lawful to perform. The legal protection for fulfillment of rights of the
Parties, should any one of the Parties commit breach of promise in the sale and purchase
agreement, is heavily dependent on the power of the sale and purchase agreement made
or entered into. That means that if such an agreement is made or entered into by virtue of
a privately drawn up deed, the protection obtained is in conformity with the protection
available under privately drawn up deed, while if the agreement is made or entered into
by virtue of a deed drawn up before the Notary Public, the deed will automatically
become a Notarial deed so that the protection of the rights will be in conformity with a
authentic deed. / Tanah adalah hal yang penting dalam kehidupan bangsa Indonesia. Salah satu cara
memperoleh tanah adalah melalui jual beli. Jual beli hak atas tanah seperti yang telah
diatur dalam Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah dan
Peraturan Pemerintah Nomor 37 Tahun 1998 tentang Peraturan Jabatan Pembuat Akta
Tanah (PPAT) harus dilakukan di hadapan pejabat yang berwenang, dalam hal tanah
adalah Pejabat Pembuat Akta Tanah (PPAT), yang daerah kerjanya meliputi daerah tempat
tanah yang diperjualbelikan itu berada. Namun terkadang tidak semua proses jual beli
dapat berjalan sesuai dengan rencana dan terdapat kendala untuk memenuhi semua
persyaratan yang berkaitan dengan pelaksanaan jual beli di hadapan notaris, maka
ditemukan suatu terobosan hukum dan hingga kini masih dilakukan dalam praktek jual
beli tanah yaitu dengan dibuatnya Akta Pengikatan Jual Beli meskipun isinya sudah
mengatur tentang jual beli tanah namun formatnya baru sebatas pengikatan jual beli yaitu
suatu bentuk perjanjian yang merupakan atau dapat dikatakan sebagai perjanjian
penduhuluan. Penelitian ini bertujuan untuk mengetahui tentang bagaimana praktek
penggunaan Akta Perjanjian Pengikatan Jual Beli dalam proses jual beli tanah yang
belum memenuhi persyaratan dengan mengambil contoh Akta Notaris Pengikatan Jual
Beli di Jakarta Selatan. Penelitian ini bersifat deskriptif analitis dengan pendekatan
yuridis empiris, sedangkan data diperoleh, melalui penelitian kepustakaan dan wawancara
dengan notaris sebagai sumber. Dari hasil penelitian ini disimpulkan kedudukan dari Akta
Perjanjian Pengikatan Jual Beli hak atas tanah yang dibuat oleh Notaris dalam pelaksanaan pembuatan Akta Jual Belinya menjadi sangat penting karena merupakan
perjanjian pendahuluan serta mempunyai kedudukan yang sangat kuat karena akta
tersebut merupakan akta notaril yang bersifat akta otentik, pemberian kuasa yang tidak
dapat ditarik kembali dalam perjanjian pengikatan jual beli bukanlah termasuk ke dalam
kuasa mutlak yang dilarang oleh Intruksi Menteri Dalam Negeri Nomor 14 Tahun 1982
tentang Larangan Penggunaan Kuasa Mutlak Sebagai Pemindahan Hak Atas Tanah,
sehingga status hukumnya sah untuk dilakukan. Perlindungan hukum terhadap
pemenuhan hak-hak para pihak apabila salah satu pihak melakukan wanprestasi dalam
perjanjian pengikatan jual beli sangat tergantung kepada kekuatan dari perjanjian
pengikatan jual beli yang dibuat, yaitu jika dibuat dengan akta dibawah tangan maka
perlindungannya sesuai dengan perlindungan terhadap akta dibawah tangan, sedangkan
apabila dibuat oleh atau dihadapan Notaris maka dengan sendirinya aktanya menjadi akta
notaril sehingga kekuatan perlindungannya sesuai dengan perlindungan terhadap akta
otentik.
