Abstract
Legal dispute over land arises from the report of a party (individual or legal entity)
containing objections and demands over land rights, including the status of such land, the
priority and ownership, in the hope that they can get administrative settlement based on the
relevant laws and regulations. The disputed land in the present case belongs to H. Boing as
the owner, whereas Rudi Watak as the buyer had conducted transfer of title without prior
consent from the beneficiery. To answer this question, it is deemed necessary to conduct a
normative lgal research toward the relevant underlying laws and regulations so that a
conclusion can be logically deduced. Based on the analysis, it can be concluded that: 1) The
legal consideration of the Supreme Court’s judges in settling this land dispute, i.e. by the use
of instruments of evidence on agrarian law, play a big role in guaranteeing legal certainty and
legal protection for the rights’ holder of land; 2) Concerning the legal protection for parties
possessing proof of ownership on land in the form of certificate between H. Boing and Rudi
Watak; responsibility and compensation can still be demanded from government institution
that issued land certificate that turned out to be problematic. This thesis proposes the solution
that land dispute that arises in the society can no longer be settled through mediation. Several
cases in the Court are compared with other cases, particularly within the general court since it
is considered to improve the judicial institutions to allow them to effectively handle such
cases. In a transaction, the buyer should have asked the seller to draft a letter of statement
agreeing all the information conveyed by such beneficieries so that legal dispute over land
can be avoided. / Timbulnya sengketa hukum atas tanah adalah bermula dari pengaduan sesuatu pihak
(orang atau badan) yang berisi keberatan-keberatan dan tuntutan hak atas tanah baik terhadap
status tanah, prioritas maupun kepemilikannya dengan harapan dapat memperoleh
penyelesaian secara administrasi sesuai dengan ketentuan peraturan yang berlaku. karena
dalam kasus ini tanah yang disengketakan adalah milik H. Boing sebagai pemilik dan Rudi
Watak sebagai pembeli tanah dengan sepengetahuan H. Boing sertipikat tersebut sudah balik
nama tanpa persetujuan dari ahli waris. Untuk menjawab pertanyaan ini dilakukan penelitian
yuridis normatif terhadap peraturan perundang-undangan yang mendasarinya dan penarikan
kesimpulan secara logika deduktif. Berdasarkan analisis dapat disimpulkan bahwa: 1)
Bagaimana pertimbangan hukum putusan hakim Mahkamah Agung dalam memutuskan
sengketa tanah yaitu dengan menggunakan alat bukti menurut hukum pertanahan sangat
berperan untuk memberikan kepastian hukum dan perlindungan hukum bagi pemegang hak
atas suatu bidang tanah. 2) Bagaimana perlindungan hukum bagi para pihak yang memegang
tanda bukti kepemilikan hak atas tanah berupa (sertipikat) antara H. Boing dan Rudi Watak
yaitu pertanggung jawaban institusi pemerintah yang menerbitkan sertifikat tanah yang
ternyata bermasalah tetap dapat dimintakan pertanggung jawaban dan tuntutan ganti rugi.
kesimpulannya adalah sengketa pertanahan yang muncul dalam masyarakat tidak selamanya
dapat diselesaikan melalui mediasi ada beberapa perkara pertanahan yang masuk ke
pengadilan dibandingkan dengan perkara-perkara lain khususnya dalam lingkungan peradilan
umum, karena itu upaya membenahi pranata peradilan untuk menangani kasus-kasus
pertanahan secara tuntas. hendaknya dalam hal proses jual beli tanah, pembeli meminta
kepada penjual untuk membuat surat pernyataan menyetujui dari seluruh ahli waris sehingga
dikemudian hari tidak terjadi sengketa tanah seperti yang terjadi dalam kasus ini.
