Abstract

Pejabat Pembuat Akta Tanah (PPAT) adalah salah satu profesi yang memiliki kewenangan untuk membuat akta terkait pertanahan. Akta yang paling umum dibuat oleh PPAT adalah Akta Jual Beli (AJB). Dalam perkara ini akan membahas AJB yang dibatalkan oleh Pengadilan Tinggi Samarinda. Adapun metode penelitian yang digunakan oleh Penulis ialah yuridis normatif, dengan data utama yaitu data sekunder yang diperoleh dari bahan-bahan kepustakaan. Selanjutnya permasalahan dalam tesis ini adalah bagaimana akibat hukum atas pembatalan AJB dalam putusan Pengadilan Tinggi Samarinda nomor 112/PT/2019/ PT SMR dan bagaimana pertanggungjawaban PPAT yang aktanya dibatalkan oleh pengadilan. Sehingga permasalahan AJB yang dibatalkan oleh pengadilan dapat berakibat hukum yaitu aktanya dianggap tidak pernah ada dan tidak memiliki kekuatan hukum dalam bentuk apapun juga. Selain itu secara administratif pembukuan PPAT dan nomor AJB yang dibatalkan tersebut harus dilakukan pencoretan nomor aktanya baik pada minuta akta maupun pada buku daftar akta PPAT. Dalam perkara ini PPAT ASC, S.H., M.Kn. dapat dikenakan tuntutan gugatan ganti rugi secara perdata oleh pihak yang dirugikan atas kelalaiannya dan ketidakhati-hatiannya dalam membuat akta yang menyebabkan dibatalkannya AJB tersebut dan dapat dikenakan sanksi atas pelanggaran terhadap Kode Etik IPPAT maupun peraturan jabatan PPAT yang ia lakukan sehubungan dengan pelanggaran pada syarat AJB yang dibuat olehnya. / Land Deed Official (LDO) is one of the professions that possesses the authority to make deed related to land affairs. The most common deed made by LDO is the Sale and Purchase Deed (SPD). In this case, writer will discuss further about the SPD cancelled by Samarinda High Court. The research method used by the writer is normative juridical, with the main data, namely secondary data obtained from library references. Furthermore, the problem highlighted in this thesis are the legal consequences due to the cancellation of SPD in Samarinda High Court verdict number 112/PT/2019/PT SMR and the accountability of the LDO whose deed has been cancelled by the court, so that the SPD issue that is cancelled by the court may have legal consequences, namely the deed is deemed never to exist and does not have legal force in any form. Moreover, administratively, LDO administration and SPD number that have been cancelled must be abolished. The deed number abolition must be applied on both minuta deed and on the LDO deed register book. In this case, LDO ASC, S.H., M.Kn. may be subject to civil claims for compensation by the injured party for his negligence and carelessness in making the deed that cause the cancellation of the SPD and may be subject to sanctions for violations of the Land Deed Officials Association (LDOA) Code of Ethics and the LDO position regulations he committed in connection with the violation of the SPD requirements made by him.
