Abstract

Perjanjian Pengikatan Jual Beli (PPJB) adalah ikatan awal antara penjual dengan pembeli dalam transaksi jual beli rumah susun yang pada umumnya memiliki bentuk PPJB Notaril maupun PPJB di bawah tangan. Keduanya memiliki kekuatan hukum yang mengikat bagi para pihak yang mengikatkan diri dalam perjanjian tersebut asalkan dibuat sesuai dengan peraturan perundang-undangan. Akan tetapi, pada umumnya PPJB yang dibuat di bawah tangan oleh developer, bersifat baku dan cenderung isi dari PPJB ada yang merugikan konsumen. Penelitian ini ingin mengetahui tentang kekuatan hukum PPJB sebagai objek transaksi dan perlindungan hukum terhadap konsumen yang menandatangani PPJB. Berdasarkan penelitian yang penulis lakukan diperoleh kesimpulan bahwa selama PPJB dibuat dengan benar sesuai dengan ketentuan perundang-undang dan peraturan yang berlaku, maka PPJB sudah mempunyai kekuatan hukum mengikat dan dapat digunakan sebagai dasar untuk memperjuangkan hak dari konsumen ketika terjadi wanprestasi, baik dari konsumen ataupun dari pengembang, yang mengakibatkan terjadinya pembatalan PPJB./ A sale and purchase agreements (SPA) is the initial bond between the seller and the buyer in an apartment sale and purchase transaction that has SPA Notarial as well as SPA deed in general. Both have binding legal force for the parties who bind themselves to the agreement as long as it is made in accordance with the regulations of law. However, in general SPA is made in under the hands of developer, formal, and the content of SPA tends to detrimental to consumer. This research is designed to find out about the SPA’s legal worries as the object of transaction and legal protection for consumer who sign the SPA. Based on the research the author did, it can be concluded that as long as the SPA is made correctly in accordance with the contents of the laws and other related government regulation the SPA has already binding legal force and can be used as a basis for fighting the rights of consumers when there is default, either from consumers or developers which results in cancellation of SPA. Furthermore, legal protection as a result of sale and purchase transaction occurs not solely because of SPA, but also legal provisions (binding legal relationships). therefore, the legal protection can be obtained by every consumer in every stage of sale and purchase transaction.
