Abstract
Hukum memiliki tujuan yaitu untuk mendorong terjadinya perubahan sosial menjadi ke arah yang lebih baik melalui suatu kepastian hukum. Sistem kepemilikan tanah di Indonesia pada jaman Hindia Belanda tunduk kepada ketentuan Agrarische Wet 1870 (Stbd 1870 : 55). Jenis penelitian ini adalah Normatif Empiris, dimana penelitian dengan mengkaji kualitas dari suatu norma sehingga didapati suatu rekomendasi hukum dalam rangka pembaharuan hukum, dengan pertimbangan bahwa titik tolak penelitian terhadap hak atas tanah Barat (Eigendom) yang telah dinyatakan tidak berlaku namun masih tetap digunakan sebagai dasar hukum gugatan perdata di Pengadilan, dengan data primer sebagai pendukung data sekunder. Hasil penelitian menunjukan masih ada beberapa sengketa pertanahan yang menggunakan Hak Tanah Barat, salah satunya Putusan Pengadilan Tata Usaha Negara Jakarta Nomor 03/G/2012/PTUN.JKT tanggal 13 Juni 2012 Jo. Putusan Pengadilan Tinggi No. 195/B/2012/PT.TUN.Jkt Jo. Putusan Mahkamah Agung Nomor 217 K/TUN/2013, tanggal 25 Juni 2013, Jo. Putusan Nomor 62 PK/TUN/2014. Dalam putusan tersebut, baik judex factie dan judex juris salah menerapkan hukumnya, yaitu Penggugat menggunakan alat bukti lama berupa Eigendom Nomor 9703 yang merupakan tanah bekas Eigendom milik Raden Harsa Nata Sastra Nagara sejak tanggal 27 Desember 1907 yang menurut Pemohon bukan merupakan alat bukti yang valid. Menjadi penting fungsi penyuluhan hukum bagi Notaris sebagaimana dalam Pasal 15 ayat (2) huruf e UUJN. Kegiatan penyuluhan hukum merupakan salah satu sosialisasi untuk menggambarkan bagaimana itu keadilan. Hukum nasional tidak bisa menjamin terwujudnya keadilan itu. Fungsi penyuluhan hukum juga sebagai langkah pencegahan, korektif, presevatif dan developmental. Sebagai perlindungan hukum terhadap pembeli yang beritikad baik atas kepemilikan hak atas tanah, diatur dalam Pasal 1338 ayat (3) KUHPerdata Jo. Pasal 24 ayat (2) PP No. 24 Tahun 1997 Jo. Pasal 1963 KUHPerdata./ Law has a goal, namely to encourage social change for the better through legal certainty. The land ownership system in Indonesia during the Dutch East Indies era was subject to the Agrarische Wet 1870 (Stbd 1870: 55). This type of research is Normative Empirical, where research by examining the quality of a norm so that a legal recommendation is found in the framework of legal reform, with the consideration that the starting point of research on Western land rights (Eigendom) which has been declared invalid but is still used as a basis civil lawsuit law in court, with primary data as supporting secondary data. The results showed that there are still several land disputes that use West Land Rights, one of which is the Jakarta State Administrative Court Decision Number 03 / G / 2012 / PTUN.JKT dated 13 June 2012 Jo. High Court Decision No. 195 / B / 2012 / PT.TUN.Jkt Jo. Supreme Court Decision Number 217 K / TUN / 2013, dated 25 June, 2013, Jo. Decision Number 62 PK / TUN / 2014. In this decision, both the judex factie and judex juris applied the law incorrectly, namely that the Plaintiff used old evidence in the form of Eigendom Number 9703 which was the former Eigendom land belonging to Raden Harsa Nata Sastra Nagara since 27 December 1907, which according to the Petitioner was not valid evidence. It is important that the function of legal counseling for Notaries as in Article 15 paragraph (2) letter e of the UUJN. Legal education activities are one of the socializations to illustrate how justice is. National law cannot guarantee the realization of this justice. The function of legal counseling is also a preventive, corrective, presevative and developmental measure. As legal protection for buyers who have an intention to own land rights, it is regulated in Article 1338 paragraph (3) of the Civil Code Jo. Article 24 paragraph (2) PP No. 24 of 1997 Jo. Article 1963 of the Civil Code.
