Abstract

Indonesia and Philippines are two of largest maritime countries who have lots of similarities and share the same characteristics.The distance between them is quite near and merely separated by maritime boundary. Thus, the crimes often times happen on their frontier, which are usually called as transnational crimes.Therfore, two research question rise: 1)What is the historical background of Sangihe and Talaud as the border zone area of transnational crime? 2) What are the major transnational crimes that take place between Indonesia and Philippines maritime border lines? What are the implications of these crimes towards the security? 3) What are the actions that have been taken by Indonesia and Philippines to combat these crimes? Nonetheless, the researcher would like to stress on Human Trafficking, Illegal, Unregulated, Unreported (IUU) Fishing, and Firearms Smuggling which have direct impact towards security in Indoenesia and Philippines. The scope of research was circumscribed in 2009 -2014 period of time. Qualitative method will be used to analyze and describe the issue since the sources mostly consist of words rather than numbers. Indeed, the transnational crimes themself give adverse impact towards both countries, yet they streghthen their relation through diplomacy, agreements, and join committee which are made upon the issue. In addition, this issue indirectly become the “reflection-mirror” for both Indonesia and Philippines that show what aspects that still lacking of. / Negara Indonesia dan Filipina adalah dua negara maritim terbesar yang memilik banyak persamaan karakteristik. Jarak antara kedua negara pun terbilang dekat dan hanya terpisahkan oleh batas laut. Banyak kasus kriminal yang terjadi pada perbatasan kedua negara, yang biasa disebut sebagai kejahatan transnasional. Terdapat beberapa kejahatan kriminalitas yang sering terjadi antar negara. Maka dari itu timbulah dua pertanyaan penelitian 1) Apa latar belakang sejarah dari pulau Sangihe dan Talaud sebagai asal muasal aktivitas kriminal antara Indonesia dan Filipina? 2) Kriminalitas antar negara apakah yang paling sering terjadi antara Indonesia dan Filipina? Bagaiamana akibatnya pada keamanan kedua negara? 3) Langkah apa yang telah diambil kedua negara untuk menanggulangi hal ini? Namun, peniliti akan lebih memfokuskan pada kasus perdagangan manusia, penangkapan ikan secara illegal, dan penyelundupan senjata yang memberikan dampak langsung pada keamaan di Indonesia dan Filipina. Penelitian kali ini akan dibatasi dari tahun 2009-2014. Metode kualitatif akan digunakan dalam menganalisa kasus ini karena sumber data yang digunakan banyak terdiri dari kata kata daripada angka. Walaupun kejahatan kriminalitas memberikan dampak yang buruk bagi negara, namun hal itu membuat hubungan antar negara menjadi lebih kuat melalui diplomasi, perjanjian, dan join committee yang dibuat berdasarkan kasus tersebut. Ditambah lagi, kasus ini juga menjadi bentuk refleksi bagi Indonesia dan Philippines agar kedua negara mengetahui aspek mana yang masih kurang dalam negara mereka.
