Abstract

Kehadiran Undang-undang Nomor 4 Tahun 1996 tentang Hak Tanggungan atas tanah beserta benda-benda yang berkaitan dengan tanah mempunyai peranan yang penting. Salah satu pihak terkait dengan pelaksanaan undang-undang ini adalah kreditur pemegang hak tanggungan. Penggunaan jaminan atas tanah dapat dilakukan dengan menggunakan tanah milik tanah milik pihak ketiga, dan seringkali menimbulkan permasalahan tersendiri ketika Debitur dinyatakan wan prestasi atau pailit. Dasar untuk pendaftaran Hak Tanggungan diawali oleh Surat Kuasa Membebankan Hak Tanggungan (SKMHT) yang wajib dibuat dalam akta notaris atau akta PPAT. Suatu akta notaris harus memenuhi syarat-syarat formiil dan materiil untuk dapat dinyatakan sebagai akta notaris yang mempunyai kekuatan pembuktian sebagai akta otentik, sehingga perlu dikaji mengenai keabsahan akta notariil yang dibuat dalam proses pembebanan hak tanggungan atas jaminan penjamin utang dan eksekusi jaminan dari perseroan terbatas pailit yang objek jaminannya milik pihak ketiga tersebut. Metode penelitian yang digunakan adalah pendekatan yuridis normatif bersifat deskriptif analitis dengan pendekatan undang-undang dan pendekatan kasus. Dalam hasil penelitian dapat disimpulkan bahwa keabsahan akta notaris dalam proses pengikatan jaminan aset milik pihak ketiga menjadi sangat penting sehingga dapat mempunyai kekuatan mengikat bagi para pihak yang membuatnya dan dapat digunakan dalam proses eksekusi / Appearance of Law Number 4 of 1996 on security right to the land and the land- related goods has important role. Any party relating to implementation of this law is creditor bearing security rights. The use of guarantee to the land could be conducted using any third party’s land and it often caused any problem when the Debtor is declared being bankruptcy or failure in the performance of their obligations. Basis for registration of Security Rights is commenced by a power of attorney that burdens the rights that must be made in a notary deed or Land Deed Officer’s Deed. Any notary deed must satisfy formal and material requirements to be eligible being declared as a notary deed having evidencing power as an authentic deed, so it is required an examination on legality of notary deed made in the process of burdening security rights to the debt guarantor’s guarantee and execution of guarantee of limited liability company in bankruptcy which guarantee object belongs to the third party. In this research applies normative jurisdiction approach which is analytical descriptive in nature with law and case approaches. The results of research give a conclusion on legality of notary deed in the process of binding of assets guarantee of the third party become very important so it has binding power to the parties drawing up thereto and may be applied in the execution process
