Indonesia enacted several ministerial regulations from the Ministry of Agriculture and the Ministry of Trade in order to regulate and control the quantity of imported horticultural products entering the country. Previously, these ministerial regulations have led to a dispute with countries such as the United States and New Zealand which was settled by the WTO Panel. The Panel declared that Indonesia’s regulations on the importation of horticultural product are a form of quantitative restriction which violates the rules of the WTO since it restricts and prohibits the quantity of imports from entering Indonesia. The restrictions that are mentioned in the regulations include limiting the quantity of the imported horticultural products during the harvest period of the same product produced domestically. As a member of the WTO, it is incumbent upon Indonesia to abide by the rules laid out in the organization, including rules under the General Agreement on Trade and Tariffs (GATT). As a result, Indonesia recently revised its ministerial regulations by eliminating the provisions that the WTO Panel declared to be a form of quantitative restriction. This represents an important step for Indonesia to comply with the obligations towards the WTO and improve trade relations with other countries. However, despite the revision, several provisions of the new regulation remain which are inconsistent with the rules of the GATT and other rules of the WTO.
