Abstract
This research was conducted with the aim to know how the effort of PPATS in
overcoming the problem of deed of buying and selling which made then become
object of dispute and how Responsibility of PPATS on sale and purchase deed
which made then become object of dispute. Using the statue approach method, the
legal analysis technique with deductive logic, it can be concluded: The Deed of
Sale made by the Temporary Land Deed Officer has the legal power over a
document he made, his position as a designated government official because of
his position to carry out the duty of the land deed making official is an authentic
deed of ownership of the land rights. The Responsible Official of the Temporary
Landlord Certificate of the defendant is to provide true testimony in court of the
contents of the deed made before him, and the Effort which may be made by the
Temporary Land Deed Officer is by requesting a letter explaining the right of
seller if it is known that the land has been done previous purchase agreement. / Penelitian ini dilakukan dengan tujuan untuk mengetahui bagaimana upayaPPATS
dalam mengatasi permasalahan akta jual beli yang dibuatnya kemudian menjadi
objek sengketa dan bagaimana Tanggungjawab PPATS terhadap akta jual beli
yang dibuatnya kemudian menjadi objek sengketa. Menggunakan metode
pendekatan terhadap peraturan perundang-undangan (statue approach), teknik
analisis bahan hukum dengan logika deduktif, dapat disimpulkan: Akta jual beli
yang dibuat oleh Pejabat Pembuat Akta Tanah Sementara memiliki kekuatan
hukum atas sebuah dokumen yang dibuatnya, kedudukannya sebagai pejabat
pemerintah yang ditunjuk karena jabatannya untuk melaksanakan tugas pejabat
pembuat akta tanah adalah akta otentik atas kepemilikan hak atas tanah.
Kemudian Tanggung jawab Pejabat Pembuat Akta Tanah Sementara terhadap
akta jual beli yang digugat adalah memberikan kesaksian dengan sebenarnya
dalam pengadilan mengenai isi dari akta yang dibuat dihadapannya, dan Upaya
yang dapat dilakukan oleh Pejabat Pembuat Akta Tanah Sementara adalah dengan
meminta surat yang menerangkan mengenai alas hak dari penjual apabila
diketahui tanah tersebut sudah dilakukan perjanjian jual beli sebelumnya.
