Abstract
Notaries and Officials of the Land Deed Authority are legal professions
appointed by the government and have different duties and authorities with each other.
Article 1 Sub-Article 1 of Notice Law No. 2 Year 20014, a Notary is a public official
authorized to make an authentic deed and has other authority as referred to in this Act or
under other laws. Officials of the Land Deed Authority pursuant to Article 1 paragraph
1 of Government Regulation Number. Regulation No. 24 of 2016 Regarding the
Regulation of the Official of Deed of Land Actor, hereinafter referred to as PPAT, is a
public official authorized to make authentic deeds concerning certain legal acts
concerning the right to land or Ownership of Unit of Flats
In this study, the authors conducted data collection conducted by using a
normative juridical approach and with primary data along with secondary data. The
research approach is done by research on legal synchronization with qualitative data
analysis. From the results of research conducted can be seen that based on legal facts
and judges' judgment based on the jurisprudence of the Supreme Court of the Republic
of Indonesia Number 1657.K / Pdt / 1999 and Number. 53.K / Pdt / 1995 Deed of Sale
and Purchase Rights is null and void.
There are several ways for the bank to get legal protection as a creditor that is
by replacing the object security, immediate debt repayment, transfer of rights to the
claim to a third party and bring a lawsuit to the Court. Notary and Officer of Deed of
Land in carrying out his position more professional and in accordance with his duties
and kewenagannya as general officials. Banks as creditors in providing credit facilities
to the public would be more cautious and apply the principle of prudence in providing
credit. / Notaris dan Pejabat Pembuat Akta Tanah merupakan profesi hukum yang
diangkat oleh pemerintah dan memiliki tugas dan kewenangan yang berbeda satu sama
lain. Pasal 1 angka 1 Undang – Undang Jabatan Notaris Nomor 2 Tahun 20014, Notaris
adalah pejabat umum yang berwenang untuk membuat akta autentik dan memiliki
kewenangan lainnya sebagaimana dimaksud dalam Undang-Undang ini atau
berdasarkan undang- undang lainnya Pejabat Pembuat Akta Tanah menurut Pasal 1 ayat
1 Peraturan Pemerintah Nomor. 24 Tahun 2016 Tentang Peraturan jabatan pejabat
pembuat akta tanah, PPAT adalah pejabat umum yang diberi kewenangan untuk
membuat akta-akta otentik mengenai perbuatan hukum tertentu mengenai hak atas tanah
atau Hak Milik Atas Satuan Rumah Susun.
Dalam penelitian ini, penulis melakukan pengumpulan data yang dilakukan
dengan menggunakan pendekatan yuridis normatif dan dengan data primer beserta data
sekunder. Pendekatan penelitian dilakukan dengan penelitian terhadap sinkronisasi
hukum dengan analisa data secara kualitatif. Dari hasil penelitian yang dilakukan dapat
diketahui bahwa berdasarkan fakta hukum dan pertimbangan hakim berdasarkan
Yurisprudensi Mahkamah Agung Republik Indonesia Nomor.1657.K/Pdt/1999 dan
Nomor. 53.K/Pdt/1995 Akta Jual Beli dan Hak Tanggungan adalah batal demi hukum
sudah tepat.
Ada beberapa cara agar bank mendapatkan perlindungan hukum sebagai kreditur
yaitu dengan pengantian objek jaminan, pelunasan hutang seketika, pengalihan hak atas
tagihan kepada pihak ketiga dan melakukan gugatan ke Pengadilan. Notaris dan Pejabat
Pembuat Akta Tanah dalam menjalankan jabatannya kira lebih profesional serta sesuai
dengan tugas dan kewenagannya sebagai pejabat umum. Bank sebagai kreditur dalam
memberikan fasilitas kredit kepad masyarakat kiranya lebih berhati – hati dan
menerapkan prinsip kehati – hatian dalam memberikan kredit.
