Abstract

Dalam hal Debitor telah melaksanakan prestasinya, Bank selaku Kreditor akan mengeluarkan suatu pernyataan tertulis yang menyatakan bahwa fasilitas kredit yang telah diterima oleh Debitor telah dilunasi seluruhnya dan objek jaminan kredit tersebut tidak lagi dibebani Hak Tanggungan. Pernyataan tersebut dikeluarkan dalam bentuk Surat Keterangan Lunas dan Surat Permohonan Roya. Pencatatan pencoretan Hak Tanggungan dilakukan oleh Kantor Pertanahan atas permintaan pihak yang berkepentingan dengan memenuhi persyaratan yang telah ditentukan dalam perundang-undangan yang berlaku. Terhadap sertipikat yang merupakan objek jual beli masih tercantum Hak Tanggungan yang belum dilakukan pencatatan roya, mengakibatkan timbulnya pandangan dualisme mengenai pencatatan roya itu sendiri, apakah pencatatan roya dalam Buku Tanah dan Sertipikat Hak atas Tanah bersifat mandatori ataukah hanya bersifat administrasi. Untuk itu diperlukan penelitian mengenai keabsahan peralihan hak atas tanah dalam hal jual beli sebelum dilakukan pencatatan roya Hak Tanggungan. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan undang-undang dan pendekatan konseptual, yaitu dengan menelaah regulasi serta prinsip hukum umum yang berkaitan dengan permasalahan yang ada. Dari hasil penelitian tersebut, dapat disimpulkan bahwa jual beli tanah yang dilakukan sebelum dilakukannya pencatatan roya merupakan perbuatan hukum yang sah, dikarenakan pencatatan pencoretan Hak Tanggungan merupakan tindakan adminisratif yang dilakukan agar data mengenai tanah selalu sesuai dengan kenyataan yang ada / In the event that Debitor has been fulfill their credit obligation, Bank as a Creditor shall issued the written notice stating that the credit facility which has been received by the Debitor has been fulfilled, and the object of assurance have been released. Bank shall issued Settled Statement and Recommendation of Roya. Once Roya is conducted by the National Land Agency, they will register the Roya based on request of concerned party/es reffering to regulation. In the event that Land Certificate that is still marked as the object of assurance to the bank, and the Debitor and/or Bank still have not coducted Roya, arise several doubt or dualism of perspective regarding Roya itself, whether Roya on the Land Certificate is mandatory, or only an non-substansial administrative procedures. Based on that doubt or dualism, it is necessary to conduct a research regarding the validity of the intermediate land rights (by purchasing) before Roya is registered. In this thesis, writer conduct the data gathering with the statue approach and conceptual approach, by researching and analyze the regulation, and the general principles of law which is assosiated with the issue. Conclusion of this thesis is that Land Purchasing which is conducted before the registration of Roya is firmly valid, since the registration of Roya is a only administration aspect to keep the information of National Land Agency are updated
