Notary is a public official authorized by the state to make an authentic deed. As public officials, in carrying out notarial authority must be guided by the code of conduct and the regulations in force, which if breached could be penalized. Although there are regulations that restrict the behavior of a notary, but still found a notary who commits an offense as the writer have found in the Decision of Lhokseumawe District Court Number: 40/Pid.B/2013/PN.Lsm, IZD Notary has falsified the deed. The purpose of this research is to discuss the legal consequences for Notary who makes false deed by mentioning people name who was not present at the time of making the deed and the authority of the Notary Supervisory Board to impose sanctions to the Notary in violation the Notary Law and Notary’s Code of conduct due to counterfeiting deeds. The result of the research concludes first that regarding the legal consequences for the Notary who make a false deed by including the name of the absentee present at the time of making the deed maybe subject to sanctions in the form of oral reprimands, written warning, namely temporary dismissal, dismissal with respect suspension, or dismissal with disrespect. The District Supervisory Councils of Notaries are authorized to receive reports of violations and to hold hearings and report the results of the hearings and their examinations to the Regional Supervisory. The Province Supervisory Council of Notaries has the authority to impose sanctions on oral reprimands and written warning. The Central Supervisory Council of Notaries, has the authority to impose sanctions on temporary dismissal and propose dismissal with respect suspension, or dismissal with disrespect to the minister. / Notaris merupakan pejabat umum yang diberi kewenangan oleh negara untuk membuat akta otentik. Sebagai pejabat umum, dalam menjalankan kewenangannya notaris harus berpedoman pada kode etik dan peraturan perundang-undangan yang berlaku, yang apabila dilanggar dapat dikenakan sanksi. Meskipun terdapat peraturan-peraturan yang membatasi perilaku notaris, namun masih ditemukan notaris yang melakukan pelanggaran seperti yang penulis temukan dalam Putusan Pengadilan Negeri Lhokseumawe Nomor: 40/Pid.B/2013/PN.Lsm, bahwa Notaris IZD telah melakukan pemalsuan akta. Tujuan penelitian ini untuk membahas mengenai akibat hukum bagi Notaris yang membuat akta palsu dengan mencantumkan nama penghadap yang tidak hadir pada saat membuat akta dan kewenangan Majelis Pengawas Notaris dalam memberikan sanksi kepada Notaris yang melanggar Undang-Undang Jabatan Notaris dan Kode Etik Notaris terkait pemalsuan akta. Hasil penelitian berkesimpulan pertama bahwa mengenai akibat hukum bagi Notaris yang membuat akta palsu dengan mencantumkan nama penghadap yang tidak hadir pada saat membuat akta dapat dikenakan sanksi berupa teguran lisan, teguran tertulis, pemberhentian sementara, pemberhentian dengan hormat, atau pemberhentian dengan tidak hormat atau dikenakan sanksi pidana. Majelis Pengawas Daerah berwenang menerima laporan pelanggaran serta menyelenggarakan sidang dan melaporkan hasil sidang dan pemeriksaannya kepada Majelis Pengawas Wilayah. Majelis Pengawas Wilayah berwenang menjatuhkan sanksi teguran lisan dan teguran tertulis. Majelis Pengawas Pusat berwenang menjatuhkan sanksi pemberhentian sementara dan mengusulkan pemberhentian dengan hormat dan pemberhentian dengan tidak hormat kepada Menteri.
