Abstract

In every auction shall be led by the Auction Official, that is, a person under the laws and regulations is given special authority to carry out the sale of goods by auction. The Auctioneers shall consist of a Class I Officer from the Directorate General of State Assets (DJKN) employees to execute the forced auctions, the mandatory non-executable auctions and the voluntary non-executable auctions, in addition to the Class II Auction Officer who is a private auction official who leads the voluntary non-executable auction. Auction Official shall not refuse an auction and shall make an announcement of the completion of the sale by auction which is the auction proceeding report which is an authentic deed and has perfect proofing power. Based on Article 1868 of the Civil Code, it is clear that the announcement of the completion of the sale is an authentic deed because its form must be governed by law, it must be made by or in the presence of a public official with authority to state fully the terms and conditions upon which the sale will be made. The authentic deed granting the parties an indisputable proof of the event mentioned in the deed and the proof must in principle be considered true. A Class II Auction Officer shall be responsible for the announcement of the completion of sale he or she makes. A violation committed by a Class II Auctioneer in carrying out his or her duties and responsibilities as a public official under supervision of the Superintendent shall result in sanctions in the form of reprimand, administrative leave, dishonorably discharge and fines. / Dalam setiap pelaksanaan lelang harus dipimpin oleh Pejabat Lelang, yaitu seorang yang berdasarkan peraturan perundang-undangan diberi wewenang khusus untuk melaksanakan penjualan barang secara lelang. Pejabat Lelang terdiri dari Pejabat Lelang Kelas I yang berasal dari pegawai Direktorat Jenderal Kekayaan Negara (DJKN) untuk melaksanakan Lelang Ekseskusi, Lelang Nonekeskusi Wajib dan Lelang Noneksekusi Sukarela, disamping Pejabat Lelang Kelas II yang merupakan pejabat lelang swasta yang memimpin Lelang Noneksekusi Sukarela. Pejabat Lelang tidak boleh menolak suatu pelelangan dan wajib membuat Risalah Lelang yang merupakan berita acara pelaksanaan lelang yang merupakan akta otentik dan mempunyai kekuatan pembuktian sempurna. Berdasarkan Pasal 1868 KUHPerdata bahwa jelas Risalah Lelang merupakan akta otentik karena bentuknya haruslah diatur dalam suatu undang-undang, haruslah dibuat oleh atau dihadapan Pejabat Umum dengan kewenangan apa, kapan, dan dimana akta itu dibuat. Akta otentik memberikan kepada para pihak suatu pembuktian yang mutlak mengenai peristiwa yang disebut dalam akta dan pembuktian itu pada pokoknya harus dianggap benar. Pejabat Lelang Kelas II wajib bertanggungjawab terhadap Risalah Lelang yang dibuatnya. Suatu pelanggaran yang dilakukan oleh Pejabat Lelang Kelas II dalam menjalankan tugas dan tanggungjawabnya sebagai pejabat umum yang mendapat pengawasan dari Superintenden mengakibatkan sanksi berupa peringatan tertulis, pembebastugasan, pemberhentian dengan tidak hormat serta denda.
