The research method used in this research is research normative law because research is carried out only by examining materials library or secondary data only, then the main data source comes from data literature or secondary data, case approach and law approach (status approach), where the author will analyze Determination of the Bandung City District Court Case Number 988 / Pdt / P / 2013 / PN.Bdg concerning the elimination of mortgage rights (roya) on behalf of Tetet Suryati Budiharto (late) and Tuan Imam Sudiharto at the bank liquidated namely Bank Duta Bandung Branch. The results of the study are Debtors those who have paid off all their debts to the Bank (Creditors) should be entitled get back the Certificate made as Mortgage, as the result of the determination of the Bandung City District Court that grant the petition of the applicant and order the Court to cross out / meroya Mortgage and certificate of Mortgage owned by the applicant. / Pada saat Debitur telah melunasi seluruh hutangnya dan hendak ingin melakukan penghapusan disertai pencoretan (Roya) Hak Tanggungan pada Bank (Kreditur) tersebut, ternyata diketahui bahwa Bank (Kreditur) telah dilikuidasi, sehingga seluruh aset Bank diambil alih oleh PT. Perusahaan Pengelola Aset (Persero) atau disebut PT. PPA dahulu disebut Badan Penyehatan Perbankan Nasional (BPPN), maka pihak mana yang berwenang untuk menerbitkan/mengeluarkan Roya tersebut. Selain itu, tesis ini pula membahas mengenai bagaimana jika kehilangan surat Roya hilang, sertipikat Hak Tanggungan, serta hilangnya sertipikat hak atas tanah. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif karena penelitian dilakukan hanya dengan cara menelti bahan pustaka atau data sekunder saja, maka sumber data yang utama berasal dari data kepustakaan atau data sekunder, pendekatan kasus (case approach) dan pendekatan undang-undang (status approach), dimana penulis akan menganalisis penetapan Pengadilan Negeri Kota Bandung Perkara Nomor 988/Pdt/P/2013/PN.Bdg tentang penghapusan hak tanggungan (roya) atas nama Tetet Suryati Budiharto (alm) dan Tuan Imam Sudiharto pada bank yang dilikuidasi yaitu Bank Duta Cabang Bandung. Hasil penelitian adalah Debitur yang telah melunasi seluruh hutangnya pada Bank (Kreditur) seharusnya berhak mendapatkan kembali Sertipikat yang dijadikan sebagai Hak Tanggungan, sebagaimana hasil penetapan Pengadilan Negeri Kota Bandung bahwa mengabulkan permohonan pemohon dan memerintahkan Pengadilan untuk mencoret/meroya Hipotik sertipikat Hak Tanggungan milik pemohon.
