Abstract
Since the days of the Netherland Indies and after the Indonesian independence, the
business of fiduciary service was only being held by the government owned
corporations. There was no possibility of granting the license to private sector to
perform fiduciary service that was being held by the government owned
corporations.
The survey being conducted by the Indonesian Financial Authority (Otoritas Jasa
Keuangan – “OJK”) up until 2016, there were more than 1000 unlicensed
fiduciary services, providing similar services as of the government owned
corporations, either provided in form of private limited companies or cooperative
institutions. These unlicensed services were taken place without the supervision of
the authorized and responsible institution, in this case in Indonesia should be
performed by OJK.
In 2016, the Indonesian government issued the OJK regulation No. 31/05/2016 in
regards to the fiduciary service, which provided the possibility for private sector
to be given the license to run the said service as of the government owned
corporations, to guarantee legal certainty especially for debtors and creditors.
The problems being discussed in this research, to include how is the impact of the
enactment of the OJK regulation No. 31/05/2016, and the role of Notary in respect
to the fiduciary services in Indonesia. The research methodology being used is
normative approach, with analysis stressed on the prevailing regulations, cases,
opinion of experts, and relevant legal theories to the issue of the research being
conducted.
The result of the research is, that the OJK regulation No. 31/POJK.05/2016 in
regards to the fiduciary service, giving the opportunity to the private sector for
legally performing the fiduciary services, and for the unlicensed services to obtain
the said license from OJK by fulfilling the requirements as stated in the
regulation. Although still unsure, but for the unlicensed fiduciary services that are
still not obtaining the license according to the relevant OJK regulation, will be
penalized criminal sanction based on the provision of Article 1 of Lenders
Ordinance 1938 (Geldschieters Ordonnantie Staatsblad 1938 No. 523). The role
of Notary is on the establishment of the business entity and within the transaction
of the loan provision, as well as the provision of fiducia security, especially in the
making of the Deed of Fiduciary Agreement. / Sejak zaman pemerintahan Hindia Belanda dan setelah Indonesia merdeka, usaha
pergadaian hanya diselenggarakan oleh perusahaan kepemilikan pemerintah.
Tidak dibuka kemungkinan pemberian izin kepada pihak swasta untuk
menjalankan usaha yang dijalankan oleh perusahaan pergadaian milik pemerintah.
Survey OJK sampai tahun 2016 Terdapat tidak kurang dari 1000 usaha yang sama
dengan usaha pergadaian milik pemerintah yang dijalankan tanpa izin, baik yang
diselenggarakan oleh badan usaha berbentuk PT maupun koperasi. Usaha tanpa
izin demikian tentu berlangsung tanpa ada pengawasan dari institusi yang
berwenang dan bertanggung jawab dalam pengawasan terhadap aktivitas usaha
jasa keuangan di Indonesia, yaitu OJK.
Pada tahun 2016 pemerintah menerbitkan peraturan POJK Nomor 31/05/2016
tentang usaha pergadaian yang memberi kemungkinan bagi pengusaha swasta
untuk diberi izin usaha pergadain seperti badan usaha milik Negara. untuk
menjamin kepastian hukum terutama untuk debitur dan kreditur.
Rumusan masalah yang dibahas dalam penelitian ini adalah mengenai bagaimana
dampak dari diterbitkannya peraturan POJK Nomor 31/05/2016 tentang Usaha
Pergadaian terhadap pelaku usaha pergadaian di Indonesia? Dan peranan dari
Notaris dalam kegiatan usaha pergadaian? Metode penelitian hukum yang
digunakan dalam penelitian ini metode pendekatan normatif dengan menganalisa
yang menekankan pada peraturan perundang-undangan, kasus-kasus hukum,
pendapat ahli dan teori hukum yang relevan dengan isu penelitian yang diteliti.
Hasil dari penelitian ini adalah peraturan POJK Nomor 31/POJK.05/2016 tentang
Usaha Pergadaian memberi kesempatan kepada pelaku usaha swasta untuk secara
sah menjalankan usaha pergadaian dan memberi kesempatan kepada usaha-usaha
pergadaian swasta tidak berizin yang ada untuk mendapatkan izin usaha dari OJK
dengan cara memenuhi syarat-syarat di dalam POJK tersebut. Sekalipun tidak bisa
dipastikan tetapi terdapat kemungkinan terhadap usaha-usaha pergadaian swasta
tetap tidak berizin dengan tidak meminta izin sesuai dengan POJK Nomor
31/POJK.05/2016 dikenakan sanksi pidana berdasarkan ketentuan di dalam Pasal
1 Ordonansi Pelepas Uang 1938 (Geldschieters Ordonnantie Staatsblad 1938
Nomor 523). Notaris berperan di dalam pembentukan badan usaha dan di dalam
transaksi pemberian pinjaman serta pemberian jaminannya terutama dalam
pembuatan akta fidusia.
