Abstract
The principle of good faith is the expression of the parties to enter into an
agreement shall be in good faith. It is difficult to determine whether the parties are
doing in good faith. The criteria of good faith is different case by case
individually. Not surprisingly in practice, many judges decisions emphasize that
good faith differs. One part of the concept of good faith is a good-faith buyer. A
good-faith buyer is a concept, in a good-faith buyer must therefore be able to
provide legal protection. The land sale and purchase agreement in Indonesia is one
of the legal act of transferring land rights from the old owner to the new owner.
The concept of buying and selling land in Indonesia is different from the other
sale and purchase agreement in general. The particularly since the object are nonmoved and unregistered objects. Build the terms and materials to be able to carry
out the sale and purchase of land in Indonesia. On the judge decision is number:
534 PK / PDT / 2017, PT. X is company wants to buy some plots of land, but at
the time to transfer to name PT. X was not possible because the land is blocked.
At the District Court level and High Court, PT. X is qualified as a buyer of good
faith and given legal protection, but at the level of , PT. X is not possible, at the
level of Review, PT. X has a criterion from a buyer of good faith, and provides
legal protection. Therefore it needs to be researched and reviewed back to the
price of buyers with good intentions in buying and selling land in Indonesia. / Asas itikad baik menyatakan para pihak untuk melaksanakan perjanjian
harus berdasarkan itikad baik. Asas ini bersifat abstrak karena sulit untuk
ditentukan apakah para pihak melaksanakan dengan itikad baik. Untuk
menentukan suatu kriteria itikad baik, banyak dilihat dari kasus per kasus secara
individu. Tidak heran dalam praktinya, banyak putusan hakim yang menentukan
suatu kriteria itikad baik berbeda-beda. Salah satu bagian dari konsep itikad baik
adalah pembeli beritikad baik. Pembeli beritikad baik adalah konsep, bahwa
seorang pembeli yang beritikad baik oleh sebab itu harus dapat diberikan suatu
perlindungan hukum. Perjanjian jual beli tanah di Indonesia merupakan salah satu
bentuk perbuatan hukum pemindahan hak atas tanah dari pemilik lama ke pemilik
baru. Konsep dari jual beli tanah di Indonesia memiliki karakteristik yang berbeda
dengan jual beli pada umumnya. Salah satunya adalah benda yang menjadi objek
jual beli adalah tanah yang merupakan benda tidak bergedak dan terdaftar.
Terdapat syarat formil dan materiil untuk dapat melaksanakan jual beli tanah di
Indonesia. Pada putusan nomor: 534 PK/PDT/2017, PT. X seorang pembeli
hendak membeli beberapa bidang tanah, akan tetapi pada saat akan dibalik nama
ternyata tidak dapat dilakukan karena tanah diblokir. Di tingkat Pengadilan Negeri
dan banding, PT. X dikualifikasikan sebagai pembeli beritikad baik dan diberikan
perlindungan hukum, akan tetapi pada tingkat Kasasi, PT. IPA tidak memiliki
kriteria tersebut, pada tingkat Peninjauan Kembali, PT. IPA memiliki kriteri dari
pembeli beritikad baik, sehingga diberikan perlindungan hukum. Oleh sebab itu
perlu diteliti dan ditelaah kembali mengenai kriteria dari pembeli beritikad baik
dalam jual beli tanah di Indonesia.
