This thesis aims to analyze the legal force on deed of mutual funds in the form of Collective Investment Contracts (CIC) made by the investment manager and the custodian bank, yet binds the participation of unit holders from the point of view of mutual fund as general, its deed of mutual funds in the form of CIC, and the prevailing regulations. Thus, the analysis has also done on the legal protection for the participation of unit holders in the point of view of its deed of mutual funds in the form of CIC and the prevailing regulations, including dispute settlement. The legal research method that used in this thesis is the normative legal research, meanwhile the approach method that used are the statute approach and the conceptual approach. This research resulted that the legal force on deed of mutual funds in the form CIC which binding the participation of unit holders from the point of view of mutual fund as general, its deed of mutual funds in the form of CIC, and the prevailing regulations are legal and have a robust legal evidence, even though participation of unit holder of mutual funds in the form of CIC is merely as the third party in the deed of mutual funds in the form of CIC. The legal protection for participation of unit holders in the point of view of its deed of mutual funds in the form of CIC and the prevailing regulations have provided the solid legal basis for participation of unit holders of mutual funds, however the said legal stipulations have to be made clearly with the binding law enforcement for the financial service institution to adhere it in order to accomplish the definite legal protection for participation of unit holder of mutual funds in the form of CIC. The consistent role from the Indonesian Financial Service Authority (“OJK”) as the authority for the financial service institution in Indonesia is significantly required to support accomplishment of the said legal protection. / Tesis ini bertujuan untuk menganalisis kekuatan hukum akta reksa dana berbentuk Kontrak Investasi Kolektif (KIK) yang dibuat oleh manajer investasi dan bank kustodian namun mengikat pemegang unit penyertaan reksa dana KIK ditinjau dari konsep reksa dana secara umum, akta reksa dana berbentuk KIK dan peraturan perundang-undangan. Oleh karena itu, juga dilakukan analisis terhadap perlindungan hukum bagi pemegang unit penyertaan reksa dana berbentuk KIK yang dimaksud ditinjau dari akta reksa dana berbentuk KIK dan peraturan perundang-undangan, termasuk penyelesaian sengketa. Metode penelitian hukum yang dipergunakan dalam penelitian ini adalah penelitian hukum normatif sedangkan metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa kekuatan hukum pemegang unit penyertaan reksa dana KIK yang mengikat pemegang unit penyertaan reksa dana KIK baik ditinjau dari konsep reksa dana secara umum, akta reksa dana berbentuk KIK dan peraturan perundang-undangan adalah sah secara hukum dan memiliki kekuatan pembuktian hukum yang kuat, meskipun pemegang unit penyertaan reksa dana berbentuk KIK hanya sebagai pihak ketiga dalam akta reksa dana KIK. Perlindungan hukum yang diberikan kepada pemegang unit penyertaan reksa dana berbentuk KIK dilihat dari akta reksa dana berbentuk KIK dan peraturan perundang-undangan telah memberikan landasan hukum yang kuat bagi pemegang unit penyertaan reksa dana, namun demikian ketentuan hukum tersebut harus senantiasa dibuat secara jelas dengan ikatan memaksa bagi lembaga jasa keuangan untuk mematuhinya agar terwujud perlindungan hukum yang nyata bagi pemegang unit penyertaan reksa dana KIK. Peranan yang konsisten dari Otoritas Jasa Keuangan (OJK) sebagai otoritas dalam bagi lembaga jasa keuangan di Indonesia sangat dibutuhkan untuk mendukung terwujudnya perlindungan hukum tersebut.
