Abstract

Purchase of land whose payments are made in stages often causes conflicts between parties who buy and sell land. To avoid this, in the sale and purchase of land, the buyer and the seller agree to create a Deed of Sale and Purchase Agreement. One of the conflicts that occurred from the sale and purchase of land is a case between PT. X with PT. Y (buyer). Sale and purchase of land is then poured into the Deed of Sale and Deed of Debt Agreement made by Notary / PPAT different. The Deed of Debt Agreement causes a dispute, in which the purchaser does not settle the payment that has been agreed upon. Because there is no follow-up and good faith from the buyer then PT. X filed a lawsuit to the West Jakarta District Court and the case continued until the court of Appeal. The formulation of the problem in this research is how the position of Deed of Debt Agreement between PT. X and PT. Y arising from the sale and purchase of a plot of land, and whether the Supreme Court Decision No.2978 K / Pdt / 2011 on the sale and purchase of land for Building Use Right has been in accordance with applicable regulations. The research method used is juridical normative. Based on the result of the research the status of the Deed of Debt Agreement Agreement between the two parties is not in accordance with the provisions in the Civil Code of Article 1754. Based on the analysis of the Court Decisions in the first level and Level of Appeal and then reinforced by the decision of appeal, the judge ruled that the defendant guilty of breach of the debt agreement made and the deed previously made are declared null and void. / Pembelian tanah yang pembayarannya dilakukan secara bertahap seringkali menyebakan konflik antar pihak yang mengadakan jual beli tanah. Untuk menghindari hal tersebut maka dalam melakukan jual beli tanah, pihak pembeli dan Penjual sepakat untuk membuat sebuah akta Perjanjian Perikatan Jual beli. Salah satu konflik yang terjadi dari jual beli tanah adalah kasus antara PT. X dengan PT. Y (pembeli). Jual beli tanah kemudian dituangkan kedalam Akta Jual Beli dan Akta Perjanjian Utang Piutang yang dibuat oleh Notaris/PPAT yang berbeda. Akta Perjanjian Utang Piutang menyebabkan sengketa, dimana pihak pembeli tidak melunasi pembayaran yang telah disepakti. Karena tidak ada tindak lanjut dan itikad baik dari pihak pembeli maka PT. X melayangkan gugatan ke Pengadilan Negeri Jakarta Barat dan kasus ini berlanjut sampai proses pengadilan di tingkat Kasasi. Perumusan masalah dalam penelitian ini adalah bagaimana kedudukan Akta Perjanjian Utang Piutang antara PT. X dan PT. Y yang timbul sebagai akibat dari jual beli sebidang tanah, dan apakah Putusan Mahkamah Agung No.2978 K/Pdt/2011 tentang jual beli tanah Hak Guna Bangunan sudah sesuai dengan ketentuan yang berlaku. Metode penelitian yang digunakan adalah yuridis normative. Berdasarkan hasil penelitian kedudukan Akta Perjanjian Utang Piutang antar kedua belah pihak tidak sesuai dengan ketentuan dalam Kitab Undang-Undang Hukum perdata Pasal 1754. Berdasarkan analisis dari Putusan Pengadilan dalam tingkat pertama dan Tingkat Banding dan kemudian diperkuat dengan putusan tingkat kasasi, hakim memutuskan bahwa menyatakan Pembeli bersalah karena melakukan wanprestasi terhadap Perjanjian Utang Piutang yang dibuat dan akta yang telah dibuat sebelumnya dinyatakan batal demi hukum.
