Abstract
The construction of apartment is the alternative solution towards the needs of
housing and residential. Apartment is a storey building, divided into parts and unit
that can be owned and used separately as residential, equipped with common
sections, objects and land. The residents of apartment are not able to avoid or
prevent the responsibility towards the use of common ownership. The Association
of Owners and Occupants of Units of Apartments (Perhimpunan Pemilik dan
Penghuni Satuan Rumah Susun - “PPPSRS”) shall be established by the owners
and occupants of the units of apartments, which is responsible to manage the
common ownership and residency. The research is conducted to find out the
answers for the issues relating to the validity of the establishment and the
legalization of the PPPSRS, and the roles of Notary in the establishment and
legalization of the said PPPSRS, the writing of the Deed of Establishment, Article
of Association and Article of Housekeeping of PPPSRS. The purpose of this
research is to review, analyze and find the validity regarding the establishment of
PPPSRS, and the role of Notary in regards to the establishment of the said
PPPSRS, the writing of the Deed of Establishment, Article of Association and
Article of Housekeeping.
The research is a juridical normative study, and the approach being applied is
statue approach.
From the research, it can be concluded that the authority of ratification of the
Deed of Establishment is the relevant government institutions performed by the
official authorities. The request being submitted must be accompanied by the
Article of Association and Article of Housekeeping. The role of Notary as the
public official is writing the minutes of meeting, and writing of the Deeds
regarding statements of all matters being decided during the meeting. / Pembangunan rumah susun adalah alternatif pemecahan masalah kebutuhan
perumahan dan pemukiman. Rumah susun adalah bangunan bertingkat, terbagi
dalam bagian-bagian dan merupakan satuan-satuan yang dapat dimiliki dan
digunakan secara terpisah untuk tempat hunian, dilengkapi dengan bagian
bersama, benda bersama dan tanah bersama. Penghuni rumah susun tidak dapat
menghindarkan diri atau melepaskan kebutuhannya untuk menggunakan
kepemilikan bersama. PPPSRS wajib dibentuk oleh pemilik dan penghuni satuan
rumah susun, yang berkewajiban mengurus pengelolaan bagian bersama, benda
bersama dan tanah bersama, serta kepenghunian. Penelitian ini dilakukan untuk
menemukan jawabanatas permasalahan mengenai keabsahan pembentukan dan
pengesahan PPPSRS, pembuatan Akta Berita Acara Pembentukan PPPSRS, Akta
Anggaran Dasar dan Akta Anggaran Rumah Tangga PPPSRS. Tujuan penelitian
ini adalah untuk menelusuri, menganalisa dan menemukan keabsahan terkait
pembentukan dan pengesahan PPPSRS, serta menelusuri dan menganalisa peran
Notaris terhadap pembentukan dan pengesahan PPPSRS, melaksanakan
pembuatan Akta (Pendirian) Berita Acara Pembentukan, Akta Anggaran Dasar
dan Akta Anggaran Rumah Tangga PPPSRS.
Penelitian ini merupakan penelitian yuridis normatif, dan pendekatan yang
diterapkan penulis untuk membahas permasalahan dalam penelitian ini adalah
menggunakan pendekatan Undang-undang (statue approach).
Dari hasil penelitian dapat disimpulkan bahwa kewenangan pengesahan Akta
Pembentukan PPPSRS, terdapat pada instansi pemerintah dan dilakukan oleh
pejabat pemerintah yang berwenang. Permohonan pengesahan harus dilampirkan
dengan Akta Anggaran Dasar dan Akta Anggaran Rumah Tangga PPPSRS.
Peranan Notaris yang sesungguhnya adalah sebagai pejabat umum yang menulis
risalah (notulen) rapat dan membuat akta perihal pernyataan dari segala apa yang
diputuskan dalam rapat pembentukan.
