Abstract

Dalam hukum Pertanahan Indonesia diatur tentang tanah wakaf. Didalam praktek terjadi sertipikat ganda atas tanah wakaf. Permasalahan yang terjadi munculnya sertipikat ganda diatas bangunan tanah wakaf atas nama Madrasah Nurul Uqba dan SDN 08 Muara Ciujung Timur pada tahun 2006 atas nama Pemerintah Kabupaten Lebak. Untuk menjawab pertanyaan ini dilakukan penelitian hukum yuridis normatif terhadap peraturan perundang-undangan yang mendasarinya, dengan sifat deskriptif analisis dan pengumpulan data secara kualitatif. Berdasarkan hasil analisis disimpulkan bahwa 1) kurangnya transparansi dalam hal penguasaan dan pemilikan tanah yang disebabkan oleh terbatasnya data dan kurangnya informasi yang tersedia di masyarakat Kabupaten Lebak yang dimana pensertipikatan tanah masih mengacu kepada akses permintaan serta Adanya unsur ketidaksengajaan dari Badan Pertanahan Nasional tanpa mengetahui terlebih dahulu bahwa sertipikat yang sebelumnya sudah ada dengan mengeluarkan sertipikat untuk SDN 08 Muara Ciujung Timur atas nama Pemerintah Daerah Kabupaten Lebak diatas lahan tanah wakaf Madrasah Diniyah Nurul Uqba, terlihat adanya unsur kelalaian pihak Badan Pertanahan Nasional. Hal yang paling penting dalam terjadinya sertipikat ganda adalah ketidakjujuran pemohon sebagai pemilik tanah yang mengajukan permohonan pembuatan sertifikat kepada pihak Badan Pertanahan Nasional, dengan memasukan data-data yang tidak sesuai dengan yang ada dilapangan serta kurang modernnya teknologi yang dimiliki pihak Badan Pertanahan Nasional dimasa lampau juga merupakan faktor lain yang menimbulkan munculnya sertipikat ganda. 2). Badan Pertanahan Nasional bukannya tutup mata dalam menyelesaikan permasalahan sertifikat ganda ini. Melalui proses mediasi, Badan Pertanahan Nasional mencoba mencari jalan keluar dan menyelesaikan setiap permasalahan yang muncul. Badan Pertanahan Nasional juga mengizinkan pada pihak yang bersengketa untuk membawa permasalahan sertipikat ganda ke Pengadilan negeri jika tidak terdapat penyelesaian dalam proses mediasi. Sarannya adalah Sebaiknya Badan Pertanahan Nasional Lebak harus senantiasa memperbaharui database mengenai status kepemilikan tanah di daerah lebak agar kasus sertipikat tanah ganda tidak terulang kembali serta pihak Badan Pertanahan Nasional Pusat harus senantiasa meningkatkan komunikasi, mengontrol, dan mengawasi kinerja Badan Pertanahan Nasional yang ada di daerah dan selalu menjalin komunikasi dengan baik antara Pemerintah Daerah dengan masyarakat setempat. Sosialisasi mengenai peraturan itu harus senantiasa dilakukan dengan berkala dan rutin / Donated / waqf land is set in Indonesian law of land and there is often occurs multiple certificates on waqf land. This problem exist, for example, in SDN 08, East Ciujung Muara, in 2006, which the first certificates owned by the Government of Lebak and the other stated it as a donated land on behalf of Madrasah Nurul Uqba. Normative legal research by collecting analysis and qualitative data on the underlying legislation are needed to answer this problem. The analysis result concluded that: 1) A lack of transparency in terms of control and land ownership due to limited data and lack of information available in Lebak. Land certification which is still referring to requests and the negligence from the National Land Agency in checking previously existed certificate when issuing certificate to SDN 08 East Muara Ciujung on behalf of the Regional Government of Lebak on the Madrasah Diniyah Nurul Uqba’s donated land. Dishonest applicant who apply for a National Land Agency certificate by entering false data as well as the lack of human resources and modern technology used by the National land Agency in the past is another factor that lead to the emergence of multiple certificates. 2). National Land Agency could help in resolving this multiple certificate problem. The National Land Agency could try to find a way out and resolve any problems that arise through the mediation process. National Land Agency could also allow the disputed parties to bring the problem to the court if there is no settlement in the mediation process. The advice is National Land Agency of Lebak should continue to update the land ownership status database so the cases for multiple land certificate will not be repeated. The Central National Land Agency should also continue to improve communications, control, and supervise the performance of the District National Land Agency and always maintained good communication between the regional government and local communities. The socialization of the regulation must always be carried out continuously and periodically
