Abstract
This reseacrh was conducted with the aim to determine the status of the deed
which can be used as a basis for making decisions for experts and people
responsible for PPATS on deeds that are not valid and have no legal power by the
court. Research in using the type of normative legal research, with the type of data
on primary, secondary and tertiary legal materials. Using the statue approach
method, qualitative analysis techniques and conclusions use deductive methods. It
can be concluded that the purchase buy deed made without the knowledge of the
other heirs can be issued because it is not in accordance with the provisions in
Article 1320. A certificate of inheritance which is the basis of making an invalid
deed of sale because it does not apply to the inheritance's ownership rights.
According to the author, PPATS did not make a mistake in making the deed
because it had been made in accordance with the laws and regulations. By law,
PPAT only records or pays a legal action carried out by the parties / viewers into
the deed. PPAT only worries what happens, what is seen, and experiences from
the parties / the following adapters adjust the formal conditions to the actual ones
and then pour them into the deed. PPAT is not required to investigate the truth of
the material content of the authentic deed. / Penelitian ini dilakukan dengan tujuan untuk mengetahui bagaimana status akta
jual beli yang dibuat di hadapan camat sebagai pejabat pembuat akta tanah
sementara tanpa sepengetahuan ahli waris yang lain dan bagaimana
tanggungjawab camat PPATS terhadap akta jual beli yang dinyatakan tidak sah
dan tidak berkekuatan hukum oleh pengadilan. Penelitian in menggunakan jenis
penelitian hukum normatif, dengan jenis data bahan hukum primer, sekunder dan
tersier. Menggunakan metode pendekatan terhadap peraturan perundangundangan (statue approach), teknik analisis kualitatif dan penarikan kesimpulan
menggunakan metode deduktif. Dapat disimpulkan bahwa akta jual beli yang
dibuat tanpa sepengetahuan ahli waris yang lain adalah dapat dibatalkan karena
tidak memenuhi syarat sepakat dalam Pasal 1320. Surat keterangan waris yang
digunakan sebagai dasar pembuatan akta jual beli tidak sah karena tidak semua
ahli waris menandatangani surat keterangan waris tersebut. Menurut Penulis,
PPATS tidak melakukan kesalahan dalam pembuatan akta karena telah dibuat
sesuai peraturan perundang-undangan. Secara hukum, PPAT hanya mencatat atau
menuangkan suatu perbuatan hukum yang dilakukan oleh para pihak/penghadap
ke dalam akta. PPAT hanya mengkonstatir apa yang terjadi, apa yang dilihat, dan
dialaminya dari para pihak/penghadap berikut menyesuaikan syarat-syarat formil
dengan yang sebenarnya lalu menuangkannya ke dalam akta. PPAT tidak
diwajibkan untuk menyelidiki kebenaran isi materiil dari akta autentik tersebut.
