The process of making the authentic deeds are the thing that must be done very carefully by the notary. By relying the legislation made specifically for the profession of Notary position, therefore a Notary should act professionally in making an authentic deed by the reason for the existence of legislation made separately for Notary. It is a matter which certainly requires them to act so thoroughly. The connection between these matters raises a number of questions, how will the authentic deed be if the Notary has proven not eligible formally and materially in the manufacturing process and how the notary will responsible for his noble profession if proven not eligible formally and materially. In writing this thesis, the type of research method that the writer uses is a normative research method that is qualitative in order to find the solution to the questions that are problematic by using library materials, existing legal theories including legislation specifically relating to Notary study. / Proses pembuatan akta otentik merupakan suatu hal yang harus dilakukan oleh seorang notaris dengan penuh kehati-hatian. Dengan mengandalkan UndangUndang yang dibuat khusus untuk profesi jabatannya, seorang notaris haruslah bertindak secara profesional dalam membuat suatu akta otentik karena adanya peraturan tersebut menuntut mereka untuk bertindak dengan teliti. Keterkaitan antar hal-hal tersebut menimbulkan beberapa pertanyaan, bagaimana akibat hukum terhadap akta otentik tersebut jika notaris terbukti tidak memenuhi syarat formal dan materiil dan bagaimana notaris mempertanggung-jawabkan perbuatannya yang dianggap tidak memenuhi syarat formal dan materiil tersebut. Dalam penulisan tesis ini, jenis metode penelitian yang penulis gunakan adalah metode penelitian normatif yang bersifat kualitatif dengan maksud agar ditemukannya solusi dari pertanyaan yang menjadi rumusan masalah dengan menggunakan bahan-bahan kepustakaan, teori-teori hukum yang ada termasuk Peraturan Perundangan-Undangan khususnya yang berkaitan dengan bidang studi kenotariatan.
