Abstract
As time evolves, technologies become more sophisticated. One of the latest
technologies aimed to simplify human’s life is electronic signature which enables
someone to sign documents electronically without having to be physically present.
One of the uses of electronic signature which the writer highlights is the use of
electronic signature in a power of attorney which authorizes the authorized person
to appear before a notary and draw up notarial deeds on behalf of the authorizer.
However, as technology evolves, the issue is whether or not Indonesia’s legal
principles, specifically the regulations relating to notary profession, have
acknowledged the validity of electronic signatures, especially power of attorneys
signed electronically as a basis of a notary’s authority in drawing up a notarial
deed.
In this study, the data were collected based on the legislation approach by
studying and analyzing the regulations related to notary profession and electronic
signatures. From this study, the writer concludes that although Indonesia has
enacted the legal basis which acknowledges the validity of electronic signature
through Law No. 19 of 2016 jo Law No. 11 of 2008 re Information and Electronic
Transaction, but Law No. 2 of 2014 jo. Law 30 of 2004 re Notary Profession has
not yet acknowledged the concept of electronic signatures and the existing
technologies in Indonesia has not yet been supportive. / Seiring berkembangnya jaman, teknologi pun semakin canggih. Salah satu
teknologi yang ditujukan untuk mempermudah hidup manusia adalah tanda
tangan elektronik yang memungkinkan seseorang untuk menandatangani
dokumen secara elektronik tanpa harus hadir secara fisik. Salah satu contoh
penggunaan tanda tangan elektronik yang disorot oleh penulis adalah penggunaan
tanda tangan elektronik pada surat kuasa yang memberikan wewenang kepada
penerima kuasa untuk menghadap notaris dan membuat akta notaris atas nama
pemberi kuasa. Namun, seiring dengan perkembangan ini, yang menjadi
permasalahan apakah kaidah-kaidah hukum positif di Indonesia, khususnya
perundang-undangan mengenai profesi notaris, sudah mengakui dan mampu
memberikan perlindungan terhadap keabsahan tanda tangan elektronik, secara
spesifik surat kuasa yang ditandatangani secara elektronik sebagai dasar
kewenangan pembuatan akta notaris. Dalam penelitian ini, pengumpulan data
dilakukan dengan menggunakan pendekatan peraturan perundang-undangan, yaitu
dengan mempelajari dan meneliti perundang-undangan yang terkait dengan
profesi notaris dan tanda tangan elektronik. Dari hasil penelitian tersebut, penulis
menarik kesimpulan meskipun Indonesia telah memiliki dasar hukum yang
mengakui keabsahan tanda tangan elektronik lewat Undang-undang Nomor 19
Tahun 2016 jo Undang-undang 11 Tahun 2008 tentang Informasi dan Transaksi
Elektronik, namun Undang-undang No. 2 Tahun 2014 jo Undang-undang Nomor
30 Tahun 2004 mengenai Jabatan Notaris belum mengakui konsep tanda tangan
elektronik dan teknologi yang ada belum mendukung.
