Abstract

Profesi notaris adalah profesi yang memiliki beban dan tanggung jawab yang besar karena notaris mewakili negara dalam membuat alat-alat bukti berupa akta auntentik dan tugas lain yang ditentukan peraturan perundang-undangan. Sebagai pejabat umum, dalam menjalankan kewenangannya notaris harus berpedoman pada kode etik dan peraturan perundang-undangan yang berlaku, yang apabila dilanggar dapat dikenakan sanksi. Meskipun terdapat peraturan-peraturan yang membatasi perilaku notaris, namun masih ditemukan notaris yang melakukan pelanggaran seperti yang penulis temukan dalam Putusan Majelis Pengawas Pusat Notaris Nomor : 05/B/Mj.PPN/XI/2010. Bahwa Notaris Bambang Heryanto, SH. Telah meninggalkan Wilayah Jabatannya 7 (tujuh) hari berturut-turut. Dalam menjalankan fungsi pembinaan dan pengawasan yang baik, pemerintah telah menyusun beberapa peraturan perundang-undangan yang mengatur tugas, wewenang, dan kewajiban Majelis Pengawas Daerah, Majelis Pengawas Wilayah, Majelis Pengawas Pusat, sampai dengan Majelis Kehormatan Notaris. Permasalahan dalam hal ini adalah bagaimana Kewenangan Majelis Pengawas Notaris dalam hal memberikan kewenangan cuti dan sanksi apa yang akan diberikan kepada Notaris yang telah meninggalkan wilayah jabatannya 7 (tujuh) hari berturutut-turut. Hasil penelitian berkesimpulan pertama bahwa mengenai prosedur cuti diajukan kepada pejabat yang berwenang yaitu Majelis Pengawas Daerah, dalam hal jangka waktu cuti tidak lebih dari 6 (enam) bulan; Majelis Pengawas Wilayah, dalam hal jangka waktu cuti lebih dari 6 (enam) bulan sampai dengan 1 (satu) tahun; atau Majelis Pengawas Pusat, dalam jangka waktu cuti lebih dari 1 (satu) tahun. Kedua, bentuk sanksi yang diberikan oleh notaris yang melanggar Pasal 17 ayat (1) UUJN sudah sangat jelas akan dikenakan sanksi administratif yaitu peringatan tertulis; pemberhentian sementara; pemberhentian dengan hormat; atau pemberhentian dengan tidak hormat.
