Abstract

Bidang pertanahan berkaitan erat dengan perekonomian nasional, banyak kegiatan perekonomian yang berhubungan dengan bidang pertanahan seperti jual – beli dan tanah sebagai jaminan kredit di bank. Sedemikian pentingnya tanah bagi masyarakat sehingga dapat memicu konflik pada masyarakat yang bersengketa masalah pertanahan. Untuk mengurangi konflik tersebut diperlukan kepastian hukum. Untuk memperoleh jaminan kepastian hukum dan kepastian hak atas tanah, maka masyarakat perlu mendaftarkan tanah guna memperoleh sertifikat hak atas tanah. Pendaftaran tanah sebagai suatu proses yang diakhiri dengan terbitnya sertifikat oleh kantor pertanahan kabupaten atau kota, mempunyai manfaat bagi pihak – pihak yang berkepentingan. Sertifikat hak atas tanah memberikan rasa aman bagi pemiliknya. Sifatnya pasti dan dapat dipertanggungjawabkan secara hukum. Semua keterangan yang tercantum dalam sertifikat itu mempunyai kekuatan hukum dan harus diterima (oleh hakim) sebagai keterangan yang benar sepanjang tidak ada bukti lain yang dapat membuktikan sebaliknya. Fungsi dari penyelenggaraan pendaftaran tanah untuk memberikan alat bukti kepemilikan tanah (sertipikat) ditujukan untuk memberikan kepastian hukum dan perlindungan hukum kepada pemegang hak atas tanah. Pasal 19 ayat 2 huruf c, Pasal 23. 32, dan 38 UUPA jo Pasal 3, Pasal 4, Pasal 32 PP 24 Tahun 1997 tentang pendaftaran tanah, menyiratkan bahwa Sertipikat Hak Atas Tanah akan dapat memberikan jaminan perlindungan hukum kepada pemegang hak yang namanya tercantum dalam sertipikat sebagai alat bukti yang kuat apabila data fisik, data yuridis, data administrasinya sesuai dengan surat ukur dan buku tanah yang ada di Kantor Pertanahan dan didukung oleh warkah dan daftar umum pendaftaran tanah yang ada pada Kantor Pertanahan. Buku tanah, surat ukur, warkah, dan daftar-daftar umum yang tersimpan pada Kantor Pertanahan itu disebut arsip pertanahan / The field of land is closely related to the national economy, many economic activities related to the land sector such as buying and selling and land as collateral for credit at the bank. So important the land for the community so that it can trigger the conflict in the community in the land dispute issues. To reduce the conflict is required legal certainty. To obtain legal certainty and certainty of land rights, the community needs to register the land to obtain a land title certificate. Land registration as a process ending with the issuance of a certificate by the district or municipal land office, has benefits for interested parties. Land rights certificates provide a sense of security to the owners. The nature is definitely and can be accounted for by law. All statements contained in the certificate shall have the force of law and shall be accepted (by the judge) as true insofar as there is no other evidence to prove otherwise. The function of the registration of land to provide evidence of land ownership (certificate) is intended to provide legal certainty and legal protection to the holders of land rights. Article 19 Paragraph 2 Sub-Paragraph c, Article 23, 32 and 38 of the LoGA Article 3, Article 4, Article 32 of PP 24 of 1997 concerning land registration, implies that the Land Rights Certificate will be able to provide legal protection to the rights holders whose names are listed In the certificate as a strong evidence when the physical data, juridical data, administrative data in accordance with the measurements and books of land in the Land Office and supported by warkah and general register of land registration in the Land Office. Books of land, letters, warkah, and general lists stored in the Land Office are called archives of land
