Abstract

Pembangunan komersial tidak terlepas dari kebijakan perumahan pada umumnya, peran Pemerintah dan swasta harus lebih besar dalam pengadaan fasilitas pendukung perumahan dan hotel, Permasalahan yang muncul dalam pemenuhan kebutuhan terhadap pembangunan salah satunya adalah pengembang harus memberikan 40% dari luasan lahan untuk menyediakan fasos – fasum kepada pemda, pembuatan properti kerap menjadi sorotan karena maraknya pembangunan tidak lagi melihat aturan yang berlaku, perlindungan terhadap konsumen tidak menjadi prioritas utama dalam dunia bisnis, melainkan keuntungan yang diperoleh pelaku usaha, tidak terkecuali dalam bidang perumahan dan komersial yang saat penulis bahas terkait Apartemen Mutiara yang dibangun dikota bekasi memakai lahan fasos-fasum. Sebagaimana persyaratan teknis yang tertuang dalam pasal 6 UURS mengatur tentang ruang, struktur, komponen dan bahan bangunan, bagian dari benda bersama. Antara struktur luas bangunan dan luas tanah yang dibangun oleh Apartemen Mutiara Kota Bekasi tidak menunjukan perbandingan yang proporsional dengan hak atas bagian benda milik bersama. Sebagai upayanya dalam menyediakan fasilitas umum yang menjadi syarat pembangunan rumah susun komersil, Apartemen Mutiara Kota Bekasi memanfaatkan lahan Negara yang menjadi aset milik Kementrian PUPR. untuk digunakan sebagai lahan parkir bagi para penghuninya. Dalam undang – undang No 1 Tahun 2011 Pemerintah Daerah Kota Bekasi menjamin hak setiap warga Negara untuk menempati, menikmati, dan/atau memiliki rumah yang layak dalam lingkungan yang sehat, aman, serasi, dan teratur. Dimulai dengan tahap perencanaan, pada tahap ini meliputi izin lokasi, izin perencanaan, IMB, serta bagaimana status tanah tempat fasilitas sosial direncanakan. Aspek pengawasan pada tahap perencanaan saat pengembang mengajukan izin pembangunan kompleks perumahan merupakan tahap pengendalian awal.
