Abstract

Berdasarkan Undang-undang Nomor 2 Tahun 2014 tentang Jabatan Notaris (UUJN), Notaris adalah pejabat umum yang berwenang untuk membuat akta otentik. Akta otentik adalah akta yang dibuat oleh atau dihadapan Pejabat yang berwenang. Akta otentik mempunyai nilai kekuatan pembuktian yang sempurna berbeda dengan akta yang tidak otentik. Yang disebut pembuktian sempurna artinya Akta tersebut hanya perlu dilihat apa adanya, tidak dapat ditafsirkan lain dan isi keterangannya sudah dianggap benar. Sedangkan, akta yang tidak otentik umumnya disebut akta dibawah tangan, yaitu akta yang dibuat atas dasar kesepakatan para pihak yang pembuatannya tidak harus dihadapan pejabat yang berwenang, sehingga akta ini berkekuatan hukum hanya sepanjang kedua pihak mengakui tanda tangan perjanjian tersebut. Pada saat akta otentik yang dibuat oleh Notaris dengan melanggar suatu ketentuan UUJN, hal ini dapat mengakibatkan akta hanya mempunyai kekuatan pembuktian sebagai akta dibawah tangan. Sanksi tersebut diberikan apabila pihak yang bersangkutan dengan akta telah mengalami kerugian menggugat melalui pengadilan, dan pengadilan memutuskan bahwa akta yang dibuat oleh Notaris terbukti cacat bentuk atau isinya ataupun telah melanggar peraturan perundang-undangan. Tetapi bagi notaris yang telah mengkonstantir suatu akta dengan tanggung jawab, jujur dan berpegang pada aturan undang-undang, tidak perlu takut untuk digugat, karena akta otentik secara langsung dapat melindungi dirinya sendiri termasuk notaris. Sehingga, suatu akta notaris haruslah dibuat menjadi perjanjian yang seturut dengan peraturan perundang-undangan bukan merugikan para pihak yang tercantum tetapi dapat menjadi bukti yang dipertanggungjawabkan apabila terjadi masalah nantinya / A Notary, according to the Law of Notary 2014, is a public official who is given sufficient authority by the state to make an authentic deed. The authentic deed can also be called as a notarial deed, one which is written by or in the presence of a public official. A notarial deed that is written according to the law of notary has the power to be taken as absolute evidence in the court. This indicates that everything written in the deed is true and cannot be decipher otherwise. A notarial deed is different compared to a private deed that is written between two parties. It is a contract that can also be used as evidence in the court, only under a condition where the two parties admit their signature inside the deed. When a notarial deed is not written in accordance to the Law number 2 of 2014 on Notary, the deed will be degraded into a private deed. This sanction will be given to a notary’s deed if the injured party brings a claim of injury the other party, and the court finds that the notary deed is indeed a legally proven defected notarial deed. A legally defected notarial deed is a deed that is written not in accordance to the law, either in a formative or in material perspective. But a good notary that writes a notarial deed with good will, responsibility, honesty, in a professional manner, and in accordance to the law of notary, should not worry about the claim from the plaintiff or the injured party. This is because the notarial deed will protect itself by testifying the truth of both parties, which includes protecting the notary. That is why, it is important for a notary as a public official to write every deed in a responsible manner, to rely on the law of notary, and to testify only the truth; so that the deed does not injure any parties - including the third party, and can be used as responsible evidence in the court
