Abstract

Bank sebagai Kreditor yang meminjamkan uang kepada Nasabahnya atau Debitor akan meminta suatu jaminan kepada Debitor, hal tersebut dilakukan untuk melindungi kepentingan Kreditor dalam hal Debitor gagal melunasi hutangnya atau wanprestasi. Salah satu dari jaminan tersebut adalah Tanah. Debitor yang tidak dapat melunasi pinjaman atau melakukan wanprestasi, akan diberikan aanmaning atau peringatan dan apabila dalam waktu yang telah ditentukan Debitor tidak dapat melunasi utangnya, maka Kreditor sebagai pemegang hak tanggungan pertama, berhak melelang objek jaminan yang diberikan oleh Debitor berdasarkan Pasal 6 UUHT yaitu apabila Debitor wanprestasi, pemegang hak tanggungan pertama mempunyai hak untuk menjual objek hak tanggungan atas kekuasaan sendiri melalui pelelangan umum. Namun dalam Putusan Nomor 02/PDT.G/2010/PN.MGL, Kreditor melakukan eksekusi sita jaminan melalui Pengadilan Negeri. Penulis menemukan adanya penetapan nilai limit lelang yang tidak wajar yang ditetapkan oleh Pengadilan Negeri Magelang. Pengadilan Negeri Magelang menentukan nilai limit lelang dibawah harga riil yaitu dibawah NJOP dalam lelang pertama. Penulis ingin meneliti mengenai keabsahan penetapan nilai limit oleh Pengadilan Negeri serta perlindungan hukum terhadap Debitor dan Kreditor yang dirugikan atas penetapan nilai limit yang terlalu rendah tersebut. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan undang-undang, pendekatan kasus dan pendekatan konseptual, yaitu dengan menelaah peraturan perundang-undangan serta prinsip hukum umum yang berkaitan dengan permasalahan yang ada. Dari hasil penelitian tersebut, dapat disimpulkan bahwa penetapan nilai limit oleh Pengadilan Negeri yang tidak mengikuti hasil penilaian dari Penilai Publik sangat merugikan Debitor maupun Kreditor / Bank as Creditor which gives a loan to its Customer or Debtor, will ask for mortgage, this happen because to protect the Creditor interest in event that Debtor failed to pay off its debt or default. One of the mortgages is the Land. Debtor which failed to pay off its debt or default, will gives an aanmaning or warning letter and if the Debtor cannot pay off its debt on time, thus Creditor as the first holder of security rights over the land, is entitled to auctioning the mortgage which given by Debtor according to Article 6 of Law of Security Rights over Land (UUHT) that says if Debtor defaults, the first holder of security right over land is entitled to sell the mortgage by itself through the auction. Meanwhile in the Verdict Number 02/PDT.G/2010/PN.MGL, Creditor is executing the mortgage through Civil Court. Writer found that the Magelang Civil Court gives unusual determination of the limit value in auction. Magelang Civil Court determines the limit value in auction below the rill value which also below the Selling Value of Tax Object (NJOP) in the first auction. Writer wants to study the validity of the determination limit value by Civil Court and also the legal protection against the Debtor and Creditor which has been damaged because of the determination limit value is too low. In this study, Writer gathering the data using the statute approach, case approach, and conceptual approach, by researching and analyze the regulation, and the general principles of law which is assosiated with the issue. Thus conclusion of the research, is the determination limit value by Civil Court which did not follow the determination of the limit value by Public Appraisal is very damaging, not only for Debtor but also Creditor
