Abstract

Notaris di Indonesia dalam menjalankan tugas dan jabatannya dibutuhkan pengawasan dan pembinaan oleh pemerintah. Tujuan dari pengawasan adalah agar para Notaris ketika menjalankan tugas jabatannya memenuhi semua persyaratan yang berkaitan dengan pelaksanaan tugas jabatan Notaris, demi untuk pengaman kepentingan masyarakat, karena Notaris diangkat oleh pemerintah, bukan untuk kepentingan diri Notaris sendiri melainkan untuk kepentingan masyarakat yang dilayaninya. Pengawasan Notaris dilakukan oleh Menteri dengan membentuk Majelis Pengawas Notaris yang terdiri dari Majelis Pengawas Daerah (MPD) di Kabupaten/Kota, Majelis Pengawas Wilayah (MPW) di Provinsi dan Majelis Pengawas Pusat (MPP) di Jakarta. Berdasarkan latar belakang tersebut, Rumusan masalah dalam penelitian ini adalah, bagaimana tindakan Majelis Pengawas Daerah (MPD) Notaris Tangerang Selatan dalam menyelesaikan pelanggaran kode etik oleh Notaris? Serta bagaimana Pengawasan dan Pembinaan Bagi Notaris di Tangerang Selatan agar tidak terjadi pelanggaran kode etik Notaris? Metode pendekatan yang digunakan adalah metode yuridis-normatif, Spesifikasi Penelitian: deskriptif-analisi, sumber/jenis data dari data sekunder, teknik pengumpulan data: studi kepustakaan, teknik analisis data: analisis kualitatif normatif, dengan penarikan simpulan secara deduktif. Hasil penelitian ini menemukan bahwa secara umum, Majelis Pengawas Daerah Notaris kota Tangerang Selatan dan Dewan Kehormatan telah melakukan pembinaan dan pengawasan dengan cukup baik dan efektif dalam menyelesaikan pelanggaran kode etik oleh Notaris dan Majelis Pengawas Daerah Notaris kota Tangerang Selatan telah melakukan pembinaan dan pengawasan untuk meningkatkan kesadaran hukum bagi Notaris dalam mentaati kode etik Notaris. Hal ini didasarkan pada bukti-bukti bahwa pembinaan dan pengawasan telah dilakukan sesuai dengan ketentuan dan dasar hukum yang telah ditetapkan. Saran dari penelitian ini adalah diharapkan Majelis Pengawas Daerah Notaris Kota Tangerang Selatan meningkatkan kinerjanya, terutama dalam bidang pengawasan dan pembinaan, dengan meningkatnya kinerja pembinaan dan pengawasan, diharapkan para Notaris di Tangerang Selatan semakin baik dan profesional dalam menjalankan tugas dan jabatannya / Notary in Indonesia in carrying out his duties and supervision and guidance required by the government. The purpose of supervision is that the Notary when performing his respective duties meets all the requirements relating to the implementation of the Notary office duties, in order for the security interests of the community, as a Notary appointed by the government, not for its own sake but for the sake Notary communities it serves. Notary supervision carried out by the Minister by forming a Notary Supervisory Council consisting of the Regional Supervisory Council (MPD) in the District / Municipal Supervisory Council Region (MPW) in the Province and the Central Supervisory Council (MPP) in Jakarta. Based on this background, formulation of the problem in this research is, how the actions of the Supervisory Council of Regions (MPD) Notary South Tangerang in resolving violations of code of ethics by the Notary? And how Supervision and Guidance For Notary in South Tangerang in order to avoid violation of code of ethics Notary? The method used is the method of juridical-normative, Research Specifications: descriptive analysis, sources / types of data from secondary data, data collection techniques: literature study, data analysis techniques: qualitative analysis of normative, by drawing conclusions deductively. The results of this study found that in general, the Assembly Regional Supervisor Notary city of South Tangerang and board of trustees has to provide guidance and supervision fairly and effectively in resolving violations of the code of conduct by the Notary and Assembly Regional Supervising Notary city of South Tangerang has to provide guidance and supervision to enhance the legal awareness for Notaries in obeying the code of conduct notary. It is based on evidence that the guidance and supervision has been carried out in accordance with the provisions and the legal basis that has been set. Suggestions from this study are expected in the Assembly Regional Supervising Notary South Tangerang City continues to boost its performance, especially in the field of supervision and guidance, with increased performance management and the supervision, Notary in Tangerang is expected that the South is getting better and professional in performing their duties and positions
