Abstract

Bank dalam menyalurkan pembiayaan murabahah kepada nasabah, tidak selamanya pembiayaan tersebut berjalan lancar, nasabah cidera janji dengan tidak membayar angsuran sesuai yang telah disepakati dalam akad menjadi penyebab pembiayaan murabahah bermasalah. Tesis ini mengangkat permasalahan latar belakang sebab-sebab pembiayaan murabahah menjadi bermasalah, dan upaya- upaya hukum yang dilakukan bank sebagai perlawanan atas bantahan nasabah dalam proses lelang eksekusi objek hak tanggungan. Jenis penelitian ini adalah termasuk dalam tipe penelitian deskriptif analitis dengan metode pendekatan yuridis normatif untuk menelliti secara lengkap permasalahan penelitian yang bersumber dari data primer dan sekunder serta tertier. Pengambilan data dilakukan dengan cara studi dokumen dan wawancara, data yang diperoleh dianalisis secara kualitatif normatif dan disajikan dalam bentuk deskriptif. Hasil pembahasannya diketahui bahwa pembiayaan murabahah bermasalah tidak saja disebabkan oleh faktor-faktor internal nasabah tetapi juga disebabkan oleh faktor-faktor internal bank. Parate Eksekusi untuk melakukan eksekusi objek hak tanggungan yang sudah memenuhi syarat legal subjek dan legal objek, dalam pelaksanaannya masih terkendala dengan adanya perlawanan yang diajukan nasabah sehingga bank masih melihat lemahnya kepastian hukum parate eksekusi dan bank masih dirugikan dengan proses waktu penangguhan lelang. Bank disarankan untuk mengajukan permohonan ulang lelang kepada ketua Kantor Pelayanan Kekayaan Negara dan Lelang kota Tasikmalaya, atau mengajukan fiat eksekusi sertipikat hak tanggungan kepada ketua Pengadilan Agama Kota Tasikmalaya. Disarankan pula untuk lebih memperhatikan asas kehati-hatian dalam menilai kelayakan calon nasabah pembiayaan /Indemnity rights execution is efforts to resolve the financing problems repayment obligations and for the certainty of law in executing guarantee rights for Bank BJB Syariah KCP Singaparna as creditor and indemnity assignee, however, in practice the Bank faced with several obstacles which are not expected. This thesis raises the issue of whether the execution of the indemnity rights over land is able to provide legal protection towards the legal importance of the bank as the holder of indemnity rights and how the bank's efforts to face obstacles that exist in the execution of Indemnity Rights, especially if there is a resistance/denial before the auction process of indemnity rights object is implemented by Kantor Pelayanan Kekayaan Negara dan Lelang. This type of research is included in type of descriptive analytical research with normative juridical approach to examine completely research problems derived from primary data, secondary, and also tertiary. Data collection was performed by means of the study of documents and interviews, the data were analyzed qualitatively normative and presented in descriptive form. The results of the discussion in mind that although the Indemnity Rights Regulations, Bank are granted executable rights, Parate Execution but when the Bank will execute the indemnity rights’s object which is already qualified as legal subjects and legal objects, in its implementation is still constrained by the opposition submitted by the clients or other parties, so that banks still can find the weakness of executorial rights of legal certainty and Bank still disadvantaged by the time of suspension of the auction. For the auction of indemnity rights object, the Bank is advised to reapply for the auction to The Chairman of the Kantor Pelayanan Kekayaan Negara of Tasikmalaya, or submit an indemnity rights fiat execution of indemnity right’s certificate to The Chairman of Pengadilan Agama of Tasikmalaya
