Abstract
In Article 2 paragraph 1 Of The Honorary Board Regulation Of The Indonesian
Notary Association Number 1 Of 2017 concerning The Fairness Limits For The
Making Of The Deed in one day, it is stated that the fairness limit for making a
deed by a Notary as a member of the association is 20 (twenty) deeds per day The
implementation of regulations in the article, especially for Notaries who are used
to serving the making of deeds of share purchase transactions, debt recognition
deeds with many guarantees, fiduciary assurance deeds and House Ownership
Credit (KPR) deeds which can exceed 20 deeds in one bond. This writing is done
by using normative juridical research methods carried out by examining library
material or mere secondary data, so that it can be said as normative legal
research or library legal research. After analysis, the authors can conclude that
the legal effects for Notaries who do violations regarding restrictions on the
amount of deeds can be in the form of internal sanctions and external sanctions.
Internal sanctions for Notaries who violate the restrictions on the amount of deeds
are organizational sanctions imposed by the Honorary Board in the form of
reprimand, warning, suspension (temporary dismissal) from association
membership, dismissal from membership, disrespectful membership or dismissal
from association membership. While external sanctions for Notaries who violate
the restrictions amount of deed is in the form of a temporary suspension. this is
regulated in Article 9 paragraph 1 letter d concerning Notary Office (UUJN)
which states that a Notary is temporarily dismissed from his position because of a
violation of duty and prohibition as stated in the Notary code of ethics. The legal
implications of deeds made by Notaries in the event of violation of the limits a
deed only has the power of proof as an underhanded deed or a deed becomes null
and void by law. This can be a reason for those who suffer losses to demand
reimbursement of costs, compensation and interest to the Notary as contained in
Article 84 UUJN. / Pada Pasal 2 ayat 1 Peraturan Dewan Kehormatan Pusat Ikatan Notaris Indonesia
Nomor 1 Tahun 2017 tentang Batas Kewajaran Jumlah Pembuatan Akta Perhari,
dinyatakan bahwa batas kewajaran dalam pembuatan akta oleh Notaris sebagai
anggota perkumpulan adalah 20 (dua puluh) akta perhari, sedangkan pada
praktiknya masih tidak dilaksanakannya peraturan pada pasal tersebut, terutama
bagi Notaris yang biasa melayani pembuatan akta transaksi pembelian saham,
akta pengakuan utang dengan banyak jaminan, akta jaminan fidusia dan akta
Kredit Pemilikan Rumah (KPR) yang bisa melebihi 20 akta dalam satu kali
pengikatan. Penulisan ini dilakukan dengan menggunakan metode penelitian
yuridis normatif yang dilakukan dengan cara meneliti bahan pustaka atau data
sekunder belaka, sehingga dapat dikatakan sebagai penelitian hukum normatif
atau penelitian hukum kepustakaan. Setelah dilakukan analisis, maka penulis
dapat menyimpulkan bahwa akibat hukum bagi Notaris yang melakukan
pelanggaran mengenai pembatasan jumlah akta dapat berupa sanksi internal dan
sanksi eksternal. sanksi internal bagi Notaris yang melakukan pelanggaran
mengenai pembatasan jumlah akta adalah sanksi organisatoris yang dijatuhkan
oleh Dewan Kehormatan berupa teguran, peringatan, schorsing (pemecatan
sementara) dari keanggotaan perkumpulan, onzetting (pemecatan) dari
keanggotaan perkumpulan atau pemberhentian dengan tidak hormat dari
keanggotaan perkumpulan. Sedangkan sanksi eskternal bagi Notaris yang
melakukan pelanggaran mengenai pembatasan jumlah akta adalah berupa
pemberhentian sementara. Hal ini diatur dalam Pasal 9 ayat 1 huruf d UUJN yang
menyatakan bahwa Notaris diberhentikan sementara dari jabatannya karena
melakukan pelanggaran terhadap kewajiban dan larangan jabatan serta Kode Etik
Notaris dan implikasi hukum terhadap akta yang dibuat oleh Notaris dalam hal
terjadinya pelanggaran terhadap pembatasan jumlah akta adalah mengakibatkan
suatu akta hanya mempunyai kekuatan pembuktian sebagai akta di bawah tangan
atau suatu akta menjadi batal demi hukum dapat menjadi alasan bagi pihak yang
menderita kerugian untuk menuntut penggantian biaya, ganti rugi dan bunga
kepada Notaris sebagaimana terdapat pada Pasal 84 UUJN.
