Abstract

A notary is a public official who is authorized to make authentic deeds and has other authorities as referred to in the Notary position law or under other laws. In carrying out its authority, the Notary is guided by the Code of Ethics and the prevailing laws and regulations, which can be subject to sanctions. Although there are regulations that limit the behavior of Notaries, but there are still found Notaries who commit violations as the author found in the decision of the DKI Jakarta Notary Area Supervisory Board Number 02 / PTS / Mj.PWN.Prov DKI Jakarta / III / 2015. That Yusmaneli, S.H., as a Notary in the East Jakarta area who was proven negligent in issuing an agreement without the coincident from Endang Purwanti as a former wife of Ir. Monang Tampubolon. Against the actions she did, the author concluded that the deed that was made by Yusmaneli, S.H. it still has legal power but Yusmaneli, SH still has to mediate together with Ir. Monang Tampubolon and Endang Purwanti, with the aim that the Ir. Monang Tampubolon is willing to surrender half of the joint assets in the form of 2 (two) land which is the object of the deed which is the rights from Endang Purwanti.. The DKI Jakarta Notary Regional Supervisory Board is also right in giving sanctions in the form of a written warning to Yusmaneli, S.H. because it violates Article 16 paragraph (1) letters a and e of Law Number 2 Year 2014 concerning Amendments to Law Number 30 of 2004 concerning Notary Position. / Notaris adalah pejabat umum yang berwenang untuk membuat akta autentik dan memiliki kewenangan lainnya sebagaimana dimaksud dalam undang-undang jabatan Notaris atau berdasarkan undang-undang lainnya. Dalam menjalankan kewenangannya tersebut Notaris berpedoman kepada Kode Etik dan peraturan perundang-undangan yang berlaku, yang apibila dilanggar dapat dikenakan sanksi. Meskipun terdapat peraturan yang membatasi perilaku Notaris, namun masih ditemukan Notaris yang melakukan pelanggaran seperti yang penulis temukan dalam putusan Majelis Pengawas Wilayah Notaris DKI Jakarta Nomor 02/PTS/Mj.PWN.Prov DKI Jakarta/III/2015. Bahwa Yusmaneli, S.H., selaku Notaris di daerah Jakarta Timur yang terbukti lalai menerbitkan akta perjanjian tanpa adanya kesepakatan dari Endang Purwanti sebagai mantan istri Insinyur Monang Tampubolon. Terhadap perbuatan yang dilakukannya, penulis berkesimpulan bahwa akta yang dibuat oleh Yusmaneli, S.H. tersebut tetap memiliki kekuatan hukum namun Yusmaneli, S.H tetap harus melakukan mediasi bersama dengan Insinyur Monang Tampubolon dan Endang Purwanti, dengan tujuan agar Insinyur Monang Tampubolon bersedia menyerahkan setengah bagian dari harta bersama yaitu berupa 2 (dua) tanah yang menjadi objek perjanjian dalam akta yang merupakan hak dari Endang Purwanti. Majelis Pengawas Wilayah Notaris DKI Jakarta juga sudah tepat dalam memberikan sanksi berupa teguran tertulis kepada Yusmaneli, S.H. karena melanggar Pasal 16 ayat (1) huruf a dan e Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris.
