Abstract

With the existence of problems that occur in the practice of sale and purchase rights to the land with a basis of PPJB (Binding of Sale and Purchase Agreement) and accompanied by a power of attorney from the landowner who has died. The sale and purchase agreement raises problems in the community because there are parties who feel disadvantaged. The basic right for sale and purchase of land can occur because the seller in the transaction process of sale and purchase agreement to obtain the land was originally proceeded by an agreement called the binding of sale and purchase agreement or it can be called paid off – PPJB. Furthermore, the signing of the AJB (which was originally PPJB) cannot be implemented by the parties because one of them already died. The research questions used for this thesis is how the validity of the sale and purchase of the land by a different party if the authorizing party dies, and what is the legal protection for the seller and buyer if the authorized person already dies. This thesis is using the normative legal method and three approaches which is statute approach, conceptual and case approach. This study obtained answers that; sale and purchase of land with the basis of PPJB and a power of attorney from the giver of the authorization already died are illegal, null and void. The legal protection for both of the parties from the sale and purchase agreement of the land is basically regulated in the regulations governing the sale and purchase agreement (land) with the terms of the sale and purchase made in accordance with the provisions of the legislation. There is a new regulation that provides protection to the parties to the land sale and purchase agreement that is not carried out in accordance with the conditions specified in the legislation (PPJB), but the legal protection is not as strong as if the land sale is carried out based on the rules of land sale transfer of land rights through the signing of AJB). / Dilatarbelakangi oleh adanya praktik jual beli hak atas tanah dengan dasar PPJB disertai dengan surat kuasa dari pemilik tanah yang sudah meninggal dunia. Perjanjian jual beli tersebut menimbulkan permasalahan di masyarakat karena adanya pihak yang merasa dirugikan. Dasar atau alas hak untuk jual beli hak atas tanah demikian dapat terjadi karena penjual hak atas tanah pada transaksi jual beli untuk mendapatkan tanah tersebut semula didahului dengan suatu perjanjian yang disebut dengan Perjanjian Pengikatan Jual Beli atau PPJB lunas. Selanjutnya, penandatanganan AJB (yang semula PPJB) tidak dapat dilaksanakan oleh para pihak karena salah satu pihaknya meninggal dunia. Rumusan masalah yang diangkat dalam tesis ini adalah bagaimana keabsahan jual beli tanah oleh pihak yang berbeda apabila pihak pemberi kuasanya meninggal dunia, Dan bagaimana perlindungan hukum bagi penjual dan pembeli apabila pemberi kuasanya meninggal dunia. Penelitian ini menggunakan metode hukum normatif, dan menggunakan tiga pendekatan, yaitu pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Hasil dari penelitian ini diperoleh jawaban, bahwa: Jual beli hak atas tanah dengan dasar PPJB dan surat kuasa dari pemberi kuasa yang meninggal dunia merupakan jual beli yang tidak sah dan batal demi hukum. Perlindungan hukum untuk para pihak dalam jual beli hak atas tanah pada dasarnya telah diatur dalam peraturan-peraturan yang mengatur tentang perjanjian jual beli (tanah) dengan syarat jual beli tersebut dilakukan sesuai ketentuan peraturan perundang-undangan. Terdapat peraturan baru yang memberikan perlindungan kepada para pihak perjanjian jual beli tanah yang tidak dilakukan sesuai dengan syarat-syarat sebagaimana ditentukan dalam peraturan perundang-undangan (PPJB), tetapi perlindungan hukumnya tidak sekuat apabila jual beli tanah dilakukan berdasarkan peraturan jual beli tanah yang seharusnya (peralihan hak atas tanah melalui penandatanganan AJB).
