Paska Putusan MK Nomor 69/PUU-XIII/2015 Tahun 2015 diputus telah memberikan angin segar bahwa Perjanjian Kawin dapat dibuat sebelum, pada saat, atau selama perkawinan dilangsungkan, sehingga WNI pelaku perkawinan campuran yang lalai membuat Perjanjian Kawin dapat membuat Perjanjian Kawin demi menyelamatkan Sertifikat Hak Milik (SHM) WNI yang hapus setelah lewat 1 (satu) tahun. Perjanjian Kawin wajib dibuat dalam bentuk Akta Notarial sebagaimana dipersyaratkan dalam Surat Edaran Dirjendukcapil dan Dirjen Bimas Islam Tahun 2017 Tentang Pencatatan Pelaporan Perjanjian Kawin. Dalam penelitian ini, jenis penelitian yang digunakan adalah yuridis normatif, pengumpulan data dilakukan dengan studi kepustakaan, pendekatan yang digunakan adalah pendekatan Perundang-undangan dan pendekatan konseptual serta data yang digunakan adalah data sekunder dengan ditambah hasil wawancara Penulis dengan narasumber Notaris senior dan Hakim sebagai pelengkap. Dari hasil penelitian penulis, dapat disimpulkan bahwa harta bawaan WNI pelaku Perkawinan Campuran selama dapat dibuktikan perolehannya yaitu sebelum perkawinan ataupun hibah dan/atau warisan, maka akan tetap menjadi harta pribadi yang penguasaan dan/atau pengalihannya tidak perlu persetujuan siapapun, namun dalam hal terjadi percampuran harta dikarenakan adanya unsur asing dalam perkawinan dengan tidak dibuatkannya Perjanjian Kawin, maka SHM yang didapat WNI dalam Perkawinan tersebut wajib dilepaskan dalam kurun waktu 1 (satu) tahun yang mana apabila lewat menjadi hapus dan pengalihannya adalah bukan dengan Akta Jual Beli PPAT melainkan secara Notarial dengan Akta Jual Beli Bangunan dan Pelepasan Hak. Mengenai Efektifitas Perjanjian Kawin yang dibuat dengan Akta Notaris paska Putusan MK Nomor 69/PUU-XIII/2015 Tahun 2015 adalah sangat efektif./ After the Decision of The Court No. 69/PUU-XIII/2015 year 2015 was enacted was bringing fresh air that the Marital Agreement can be perform before, at the time, or during the marriage is held, so that the Indonesian Citizen who conduct intermarriage which neglect to enter the Marital Agreement may enter the Marital Agreement to save the Land Ownership Certificate (SHM) which nullified by the law after 1 (one) year. Marital Agreement must be made in the form of Notarial Deed as required by the circular letter of Directorate General Citizenship and Civil Record (Dirjendukcapil) and Directorate General Moslem Society Guidance (Dirjenbimas Islam) Year 2017 on Recording of Marital Agreement Reporting. In this research, the type of research used is normative juridical, data collection is perform with literature studies, the approach used is the legal approach and conceptual approach and the data used is secondary data with the addition of the results of interviews by the author with a senior notary speakers and judges as a complement. From the results of the author's research, it can be concluded that the innate property of Indonesians who are perpetrators of Intermarriage as long as it can be proven obtained, namely before marriage or grants and/or inheritance, then it will remain a personal property whose possession and/or its transfer does not need anyone's approval, but in the event of a mixture of assets due to foreign elements in marriage with the non-establishment of the Marital Agreement, then the SHM obtained by the Indonesian Citizen in the Marriage must be released within 1 (one) year which if passing those period becomes nullified and the transfer is not with the Deed of Sale and Purchase of PPAT but by the Notarial Deed of Sale and Purchase of Buildings and Release of Rights. Regarding the Effectiveness of Marital Agreement in form of Notarial Deed after The Decision of MK No. 69/PUU-XIII/2015 year 2015 is very indeed effective.
