Sehubungan dengan Peraturan Presiden Nomor 13/2018 tentang Penerapan Prinsip Mengenali Pemilik Manfaat Dari Korporasi Dalam Rangka Pencegahan Dan Pemberantasan Tindak Pidana Pencucian Uang dan Tindak Pidana Pendanaan Terorisme, dalam mendirikian suatu Korporasi wajib mengenali tentang Pemilik Manfaat. Adapun metode penelitian yang penulis gunakan adalah penelitian hukum normatif. Penelitian hukum normatif adalah penelitian hukum kepustakaan yang mengacu pada norma hukum yang terdapat dalam peraturan perundang-undangan.definisi Pemilik manfaat adalah orang perseorangan yang dapat menunjuk atau memberhentikan direksi, dewan komisaris, pengurus, pembina atau pengawas pada korporasi, memiliki kemampuan untuk mengendalikan korporasi, berhak atas dan/atau menerima manfaat dari korporasi baik langsung maupun tidak langsung merupakan pemilik sebenarnya dari dana atau saham korporasi dan/atau memenuhi untuk kriteria sebagaimana dimaksud dalam peraturan perundang-undangan. Menteri Hukum dan Hak Asasi Manusia juga mengeluarkan peraturan dalam Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 15/2019 tentang Tata Cara Pelaksanaan Penerapan Prinsip Mengenali Pemilik Manfaat dari Korporasi. Kedua peraturan tersebut dikeluarkan oleh pemerintah untuk efektivitas pelaksanaan penerapan prinsip mengenali pemilik manfaat yang akurat, terkini dan bersedia untuk umum dan/atau publik. Dalam Peraturan Presiden Nomor 13/2018 dan Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 15/2019 disebutkan bahwa Korporasi wajib menetapkan pemilik manfaat dari korporasi, menyampaikan informasi tentang pemilik manfaat kepada instansi yang berwenang. Penulisan thesis kali ini penulis ingin mengkaji tentang pemilik manfaat serta bagaimana tanggung jawab notaris dalam menjalankan tugasnya sebagai penerima kuasa dari korporasi dalam menyampaikan informasi pemilik manfaat dari korporasi. /In connection with Presidential Regulation Number 13/2018 concerning the Application of the Principle of Recognizing the Beneficial Owner of a Corporation in the Context of Prevention and Eradication of the Crime of Money Laundering and the Crime of Financing of Terrorism, in establishing a Corporation, it is obligatory to identify the Beneficiary. The research method that the author uses is normative legal research. Normative legal research is library law research that refers to the legal norms contained in the legislation. Definition of Beneficial Owner is an individual who can appoint or dismiss the board of directors, board of commissioners, management, supervisor or supervisor of a corporation, has the ability to control the corporation, is entitled to and/or receives benefits from the corporation, either directly or indirectly, is the real owner of the funds or corporate shares and/or meet the criteria as referred to in the laws and regulations. The Minister of Law and Human Rights also issued a regulation in the Regulation of the Minister of Law and Human Rights Number 15/2019 concerning Procedures for Implementing the Principle of Recognizing the Beneficial Owner of a Corporation. Both regulations were issued by the government for the effectiveness of implementing the principle of identifying the beneficial owner which is accurate, current and available to the public and/or the public. In Presidential Regulation Number 13/2018 and Regulation of the Minister of Law and Human Rights Number 15/2019 it is stated that corporations are obliged to determine the beneficial owner of the corporation, submit information about the beneficial owner to the authorized agency. Writing this thesis, the author wants to examine the beneficial owner and how the notary's responsibility in carrying out his duties as the recipient of the power of attorney from the corporation in conveying information on the beneficial owner of the corporation.
