Abstract
Indonesia merupakan negara hukum yang menjadikan hukum sebagai dasar penyelenggaraan kekuasaan Pemerintahannya. Pembeli yang bertikad baik wajib dilindungi oleh undang-undang. Hasil penelitian dan analisis ini menggunakan jenis penelitian yuridis empiris dengan jenis data yaitu data sekunder. Teknik pengumpulan data menggunakan studi kepustakaan dan wawancara yang didukung dengan analisis data secara kualitatif, serta pendekatan yang digunakan adalah pendekatan undang-undang, pendekatan kasus, dan pendekatan konseptual. Permasalahan yang dianalisis mengenai perlindungan hukum bagi pembeli yang beritikad baik dan tugas notaris dalam menjalankan tugasnya seperti halnya mengecek sertipikat tanah sebelum dibuatnya perjanjian pengikatan jual beli. Perlindungan hukum yang dapat diberikan adalah perlindungan hukum represif yaitu berupa ganti rugi. Notaris dalam menjalankan tugasnya perlu memperhatikan Pasal 16 huruf (a) Undang-Undang Jabatan Notaris yaitu Bertindak amanah, jujur, seksama, mandiri, tidak berpihak, dan menjaga kepentingan pihak yang terkait dalam perbuatan hukum, seksama artinya bertindak cermat dan hati-hati. Meskipun tidak diatur secara jelas seperti PPAT yang mewajibkan pengecekkan sertipikat, namun notaris tetap harus bertindak cermat terhadap dokumen yang diberikan para pihak Jadi, perjanjian pengikatan jual beli yang dibuat sempurna dapat memberikan perlindungan hukum bagi para pihak, namun apa bila suatu saat timbul gugatan maka perlu dilakukan pembuktian dan notaris dalam menjalankan tugasnya harus menerapkan prinsip kehati-hatian. Perlunya pengaturan mengenai pengecekkan sertipikat oleh notaris karena hal tersebut penting untuk melindungi notaris dalam melaksakan tugas dan kewajibannya. Selain ada pengaturan terkait pengecekkan, juga perlu penerapan yang tegas atas aturan tersebut supaya notaris lebih berhati-hati/Indonesia is a legal state which sets law as the basis for implementation of its governmental authority. A buyer with good faith shall be protected by the law. The result of this research and analysis uses the normative empirical type of research with secondary type of data. The data collection technique uses literature review and interview which is supported by qualitative data analysis, as well as using statutory, case and conceptual approach. The issue analyzed is regarding legal protection for buyers with good faith and the duty of notary in conducting their duty such as checking the land certificate(s) before drawing up a conditional sale and purchase agreement. The legal protection that may be provided is the repressive legal protection in the form of compensation. Notary in conducting their duty shall take into consideration Article 16 letter (a) of the Notary Profession Law, namely to act trustworthily, honestly, carefully, independently, impartially, and to protect the interests of related parties within the legal action, carefully means to act wisely and meticulously. Although not clearly stipulated such as a PPAT which requires checking of certificate(s), however, a notary shall still act wisely towards the documents provided by the parties, therefore, the conditional sale and purchase agreement made perfectly may provide legal protection to the parties, nonetheless, if a suit emerges in the future, a verification shall be conducted and the notary in conducting their duty shall apply the prudent principle. The regulation regarding checking of certificate(s) by notary is required since it is important to protect the notary in conducting their duty and obligation.
