Abstract

Tujuan dilakukannya penelitian ini adalah untuk mengetahui perlindungan hukum jaminan sosial tenaga kerja di BPJS Cabang Medan berdasarkan undang – undang nomor 24 Tahun 2011 dan penyelesaian sengketa pelanggaran jaminan sosial tenaga kerja yang dilakukan oleh pemberi kerja di BPJS Ketenagakerjaan Cabang Medan. Jenis penelitian yang dilakukan adalah penelitian hukum normatif dengan tujuan mengkaji hukum dari beberapa aspek seperti teori, filosofi, perbandingan, struktur/komposisi, konsistensi, penjelasan umum dan penjelasan pada tiap pasal, formalitas dan kekuatan mengikat suatu Undang-Undang sehingga dapat disimpulkan bahwa penelitian hukum normatif mempunyai cakupan yang luas dan berobjek pada doktrin, asas, dan prinsip hukum. Jenis data yang digunakan adalah data sekunder dengan teknik pengumpulan data library research. Hasil penelitian menunjukkan bahwa Perlindungan hukum Jaminan Sosial Tenaga Kerja berdasarkan UU BPJS di BPJS Ketenagakerjaan Cabang Medan terdiri dari perlindungan hukum preventif dan perlindungan hukum represif. Perlindungan hukum preventif berupa kepastian hukum tentang Jaminan Kesehatan, JKK dan JKM, JP, JHT dan JKP. Perlindungan hukum represif melalui pengenaan sanksi administratif, perdata, dan pidana. Sanksi administratif berupa teguran tertulis, denda dan/atau tidak mendapat pelayanan publik tertentu. Sanksi perdata berupa ganti rugi, uang paksa atau penyitaan terhadap aset tertentu. Sanksi pidana berupa penutupan perseroan, ataupun denda dan pencabutan hak tertentu. Penyelesaian sengketa atas pelanggaran Jaminan Sosial Tenaga Kerja yang dilakukan oleh Pemberi Kerja di BPJS Ketenagakerjaan Cabang Medan dapat dilakukan melalui pengaduan ke Unit Pengendali Mutu Pelayanan dan Penanganan Pengaduan Peserta, dilanjutkan melalui mediasi dengan bantuan mediator, bila tidak tercapai kesepakatan dilanjutkan ke Pengadilan Negeri yang wilayahnya meliputi tempat tinggal pemohon. Pelanggaran yang paling banyak dilakukan oleh pemberi kerja (perusahaan) di BPJS Ketenagakerjaan Cabang Medan adalah perusahaan memungut iuran dari karyawannya tetapi tidak menyetorkannya ke BPJS Ketenagakerjaan atau perusahaan tidak memungut iuran dari pekerjanya. Mediasi dalam praktek dilakukan di Disnaker kota Medan dan mediasi di BPJS Ketenagakerjaan Cabang Medan./The aim of this research is to find out the legal protection of social workers security at BPJS of Employment Medan Branch is based on Law Number 24 of 2011 and the settlement of disputes over violations of social workers security by employers at BPJS of Employment Medan Branch. The type of research is normative legal research with the aim of examining law from several aspects such as theory, philosophy, comparison, structure / composition, consistency, general explanation and explanation of each article, the formality and binding strength of a law so that it can be concluded that legal research normative has a broad scope and is objected to legal doctrine, principles and principles. The type of data used is secondary data with library research data collection techniques. The results of the study indicate that the legal protection of social employment security at BPJS of Employment Medan Branch based on BPJS Law consists of preventive legal protection and repressive legal protection. Preventive legal protection in the form of legal certainty regarding Health Insurance, JKK and JKM, JP, JHT and JKP. Repressive legal protection through the imposition of administrative, civil and criminal sanctions. Administrative sanctions in the form of written warnings, fines and/or not receiving certain public services. Civil sanctions in the form of compensation, forced money or confiscation of certain assets. Criminal sanctions in the form of closing the company, or fines and revocation of certain rights. Settlement of disputes over violations of Social Workers Security committed by the Employer can be carried out through a complaint to the Service Quality Control Unit and Participant Complaint Handling, followed by mediation with the help of a mediator, if an agreement is not reached, proceed to the District Court whose territory includes the applicant's residence. The most frequent violations committed by employers (companies) at BPJS of employment Medan Branch are companies collecting contributions from their employees but not depositing them to BPJS of employment or companies not collecting contributions from their employees. Mediation in practice was carried out at the Medan City Manpower Office and mediation at BPJS Employment Medan Branch.
