Abstract
Penelitian dalam skripsi ini bertujuan untuk mengetahui
perlindungan hukum terhadap konsumen e-commerce yang mendapatkan
barang tidak sesuai dengan pembelian melalui media online Shopee.
Tujuan lain yaitu untuk mengetahui tanggung jawab pelaku usaha
terhadap konsumen yang mendapatkan barang yang tidak sesuai dengan
pembelian melalui media online Shopee.
Penelitian ini menggunakan metode penelitian hukum Normatif,
yaitu meneliti perlindungan hukum terhadap konsumen dalam transaksi ecommerce
atas barang yang tidak sesuai dengan pembelian melalui media
online Shopee dan tanggung jawab pelaku usaha e-commerce yang
memberikan barang yang tidak sesuai dengan pesanan. Teknik analisis
data yang digunakan adalah analisis deskriptif kualitatif. Kuisioner
sebagai data pendukung untuk menganalisis data pustaka yang diteliti
dengan cermat.
Hasil penelitian dalam skripsi ini adalah upaya perlindungan
hukum terhadap konsumen yang mendapatkan barang yang tidak sesuai
dengan pembelian melalui media online shopee diatur dalam landasan
Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan
Konsumen(UUPK) dan Undang-Undang Nomor 11 Tahun 2008 Tentang
Informasi dan Transaksi Elektronik (UU ITE). UUPK dan UU ITE secara
tertulis memberikan perlindungan yang memadai bagi konsumen dalam
melakukan transaksi jual beli melalui e-commerce. Tanggung jawab
pelaku usaha dalam penelitian ini yaitu dengan memberikan ganti rugi
atas kerusakan barang yang dibeli oleh konsumen. Apabila pelaku usaha
menolak untuk bertanggung jawab maka konsumen dapat menuntut
pembayaran ganti kerugian melalui Badan Penyelesaian Sengketa
Konsumen atau mengajukan ke badan peradilan di tempat kedudukan
konsumen. Sanksi yang diatur dalam Undang-Undang meliputi sanksi
perdata, administratif, maupun pidana, sesuai aturan terkait; sehingga
dapat memenuhi asas keadilan bagi semua pihak./The purpose of doing this thesis research is identifying whether
the e-commerces customer who get inappropriate products received the
law protection when purchase through online media Shopee. The other
purpose is knowing the selers responsibility in handling sending the
improper product to e-commerces customer when the purchase is done
through online media Shopee.
This thesis research is using Normative Law method, namely
analyzing whether it has given the appropriate law protection to the
disadvantaged online customers and surveying the sellers responsibility
due to delivering wrong or unfavourable products when the purchase has
been submitted by using shopee online shop media. The analistic data
technique is hereby used Analistic Descriptive Qualitative Technique.
Questionnaire as a proponent data is to analyze pustaka data
punctiliously.
The outcome of this thesis is to aim a proper law protection to
those online customers who received unfavourable products by using
Shopee online shop media as their transaction. There are two Act valid
for these cases, which are No.8 year 1999 Act which regulates
Protection of Online Consumers (UUPK) and No. 11 year 2008 Act that
organised Information and Electronic Transaction (UU ITE). UUPK and
UU ITE are writtenly valid Act which provide proper law protection for
online customers by using e-commerce media as their transaction. There
are two ways for the restitution as the sellers responsibility in this thesis
research which are giving an option of returning the inappropriate
products or making a refund to the online consumers. And if the sellers
reject to take a responsible, the online consumers could sue the seller
through Badan Penyelesaian Sengketa Konsumen or Badan Peradilan in
the consumers taken cases place. Legal sanction is stipulated by Act
which comprise of civil sanction, administrative sanction as well as
criminal sanction, appropriate with related regulation. Thus, both party
could gain the proper justice rights.
