Abstract

Dalam upaya pemerintah Indonesia meningkatkan pembangunan, kesejahteraan, dan kemakmuran bagi rakyatnya, salah satu cara yang dilakukan di Indonesia adalah membentuk Undang-Undang Nomor 11 Tahun 2011 Cipta Kerja. Undang-undang tersebut merubah beberapa ketentuan salah satunya perubahan dalam Perseroan Terbatas. Saat ini di Indonesia terdapat klasifikasi badan hukum baru, yaitu perseroan yang memenuhi kriteria untuk Usaha Mikro dan Kecil sebagaimana diatur dalam ketentuan peraturan perundang-undangan sebagai bentuk Perseroan Perorangan. Pengaturan melalui UU Cipta Kerja ini membuat UMK dapat memperoleh status badan hukum dan didirikan oleh satu orang ditujukan untuk memotong birokrasi juga dapat mempermudah UMK dalam berusaha, lebih lanjut dapat mendukung pemerintah meningkatkan kemudahan berusaha bagi pelaku UMK. Status badan hukum pada Perseroan Perseorangan ini diharapkan akan mempermudah pelaku UMK dalam menjalankan usaha. Perseroan perseorangan juga mendapatkan berbagai insentif dari pemerintah, hal ini tentunya akan banyak menarik para pelaku usaha untuk membuat perusahaan berbentuk perorangan. Insentif ini akan berasal dari dana pemerintah, sehingga baik penyalurannya hingga pelaksanaan usahanya memerlukan laporan keuangan sebagai salah satu alat pemerintah melakukan pengawasan agar ketentuan perseroan perseorangan ini dapat dilaksanakan dengan efektif dan efisien sehingga tujuan pemerintah bisa tercapai./ According to Indonesian government to improve development for its people, one of the alteration was to establish Law Number 11 of 2011 on Job Creation. The law changes several provisions, one of which is changes in Limited Liability Companies. Currently in Indonesia there is a new classification of legal entities, namely companies that meet the criteria for Micro and Small Enterprises as stipulated in the provisions of the legislation as a form of Individual Company. An individual company is a company established by 1 (one) person where the shares of this company are owned solely by one person (or one legal subject). The legal entity status in the Sole Proprietorship is expected to make it easier for MSEs to obtain business. Various facilitate obtaining business permits by monitoring the business sustainability of a business through financial reports. Individual limited liability companies also get various incentives from the government, this will certainly attract a lot of business actors to create companies in the form of individuals. This incentive will come from government funds, so that both distribution and business implementation need supervision so that the provisions of this sole proprietorship can be implemented effectively and efficiently so that the government's objectives can be achieved.
