Indonesia as a state of the law has an obligation to guarantee protection to the entire community to be able to carry out worship according to their beliefs as referred to in Article 28 and Article 29 of the 1945 Constitution. Umrah pilgrimage is an alternative to praying to the holy land because the waiting period for Hajj departures is up to 39 years in 2019. The very high public interest in carrying out the Umrah pilgrimage opens enormous business opportunities for the organizers of the Umrah pilgrimage (PPIU), but on the other hand, it has weaknesses in the protection of the Umrah pilgrims so that many prospective Umrah pilgrims are disadvantaged because they are dispatched to the holy land by the organizers of the Umrah pilgrimage. The losses that have occurred have reached trillions of rupiah which have caused hundreds of millions of people to lose their money. This legal research was conducted with the aim of exploring and analyzing the regulations regarding organizing the Umrah pilgrimage in Indonesia, the implementation of the Umrah pilgrimage, deviation of implementation, as well as the ideal Umrah pilgrimage arrangements. The aim is to find a model for the protection of the rights of prospective Umrah pilgrims to obtain certainty about the implementation of the Umrah pilgrimage. The research method used is normative legal research, with a statutory approach, a case approach, a comparative approach, and a conceptual approach with the support of relevant case studies. The results of the study indicate the need for amendments and harmonization of Law No. 8/2019 concerning the Implementation of Hajj and Umrah, as well as revisions and harmonization of implementing regulations. The ultimate goal is to provide protection and certainty to insure departing for the Umrah pilgrimage to all prospective Umrah pilgrims through sharia Umrah departure insurance. / Indonesia sebagai negara hukum memiliki kewajiban untuk memberikan jaminan perlindungan kepada seluruh masyarakat untuk dapat melaksanakan ibadah sesuai keyakinannya sebagaimana Pasal 28 dan Pasal 29 UUD 1945. Ibadah umrah menjadi alternatif pekasanaan ibadah ke tanah suci karena masa tunggu keberangkatan haji mencapai 39 tahun pada tahun 2019. Animo masyarakat yang sangat tinggi untuk melaksanakan ibadah umrah membuka peluang usaha yang sangat besar bagi penyelenggara perjalanan ibadah umrah (PPIU), namun disisi lain memiliki kelemahan dalam perlindungan jamaah umrah sehingga banyak calon jamaah umrah yang dirugikan karena tidak diberangkatkan ke tanah suci oleh penyelenggara perjalanan ibadah umrah, kerugian yang terjadi mencapai trilliunan rupiah yang merugikan ratusan juta orang. Penelitian hukum ini dilakukan dengan tujuan untuk menelusuri dan menganalisis pengaturan penyelenggaraan ibadah umrah di Indonesia, implementasi penyelenggaraan ibadah umrah, kendala dan penyimpangannya, serta pengaturan penyelenggaraan ibadah umrah yang ideal. Tujuannya untuk menemukan model sistem perlindungan hak calon jamaah umrah untuk mendapatkan kepastian pelaksanaan ibadah umrah. Metode penelitian yang digunakan adalah penelitian hukum normatif, dengan pendekatan undang-undang, pendekatan kasus, pendekatan komparatif dan pendekatan konseptual dengan dukungan studi kasus yang relevan. Hasil penelitian menunjukan perlunya amandemen terhadap Undang-Undang No. 8 Tahun 2019 tentang Penyelenggaraan Haji dan Umrah, sekaligus revisi dan harmonisasi terhadap peraturan pelaksananya. Tujuan akhirnya adalah memberikan perlindungan dan kepastian keberangkatan umrah kepada seluruh calon jamaah umrah melalui asuransi pemberangkatan umrah syariah.
